Assault charges while PR application is 'On Review' status

Hi,

I have been charged with assault charges recently and am not sure how to proceed with my PR application under CEC (Canadian Experience Class). I have only been charged, not being convicted or discharged yet.

What do I do in this type of situation?

IRCC will wait to continue your application until your charges are resolved. You should inform them, because they will certainly find out on their own.

Wait and see if you actually get a discharge. It will depend on your outcome.

You will have to always answer "have you ever been charged with a crime" with yes, though, and provide details on any application that asks this question.

Do you know what happens if I get conditional discharge or Community Jail or Home Arrest.

@k.h.p. So I have got a conditional discharge with 1 year probation.
I did not let them (CIC) know yet, but now I can.
What is the possibility of me getting my PR now?

You need to talk to a lawyer, sorry. I'm not qualified to give you advice on this.

You wouldn't be able to apply for PR until some time after the completion of your probation - there's a period of time where the conditional discharge stays on your record, because if you commit another crime, the "conditional discharge" becomes a conviction.

For an absolute or conditional discharge:

• If the offence occurred in Canada, you are not inadmissible.
• If the offence occurred outside Canada, you may be inadmissible.

This seems to be good news for you. I really think that based on this you don't actually need a lawyer.
