If she can get an approved LMIA then she can apply for a closed work permit before August 17th and continue working.
Hopefully she gets an approved LMIA. I don't know why IRCC has been strict. for getting PR She is working 3 jobs but the 2 jobs both under Government. The other one is city in Ontario as a Zumba Instructor mostly she teach 18+ and Seniors and working for 2 years now. She also working in a fitness gym. also as a Zumba Instructor.

Is the employer willing to go through the LMIA process? They need to start now. Note that the job needs to be full time.

She is currently working as a full time. The other job that she has is a youth centre under a local government of that small town. She is currently working for 1 year and 2 months. I hope she convince them again this week. If not , I hope she can learn french within the restoration window to get LMIA exempt for her. I know that she is not able to work in that time. Much better before her PGWP expires or find a job for LMIA-Approved before PGWP Expires.
 
I am asking on behalf of a friend. Here is her situation. She has a PGWP that will expire this coming August 17, 2025. The employer is unaware of the Labour Market Impact Assessment (LMIA). She asks the employer for LMIA this May. She plans to switch to a visitor record. In the future, can she apply for a Work Permit with a French LMIA - Exempt or a Work Permit with an LMIA After her Visitor Record is approved or during the processing of her Visitor record, while she is in implied status, she plans to take the French at the end of 2025? She is studying French right now. She submitted her Express Entry application, but due to a low score of 399, which was caused by being overage, I suggested that she study French, as this is the only way to obtain a PR. Her occupation is not in demand here in Canada.

How old are your parents? Realistically after a certain age it will be very difficult for them to remain in Canada longterm or qualify for PR.

Over 50. I know it is difficult but we have submitted by our consultant for OINP NOI Foreign Worker Stream and earned 50 pts last November 2024 but we are still waiting for the draw because if OINP works out we don't have to worry about it and we submitted Express Entry by our consultant. We are laying our options to remain in Canada longer. If OINP no draw and I don't know when she will take French , that is our only hope for now. But If we get LMIA well , we have some light at the end of the tunnel.

If she hasn't already started learning French then I think it's too late for the plan to secure an LMIA exempt work permit based on knowing French. She should have started last year.
 
She already started learning French but I'll see if she can take the exam in her restoration (90 day period). I will confirm with her because when she will take french. This week , there will be a staff meeting performance evaluation so I'll see if the employer is gonna support her.

I would think she would need to take the test while she still has valid status or she won't get the results soon enough to have time to complete the work permit application and restoration.

IMO - She is very short on time and needs to have a back up plan if none of this pans out.

But if she cannot take French within 90 days, my hope for us is to at least get the French test done and eventually receive an AOR for PR — maybe under the French-speaking stream Express Entry with added points or OINP Human Capital Stream maybe she will qualify. Honestly, we talk about this every day, weighing all the options — restoration, visitor status, LMIA-exempt, Temporary Policies in the future , LMIA , Switching her to Study Permit(Masteral) , PR streams — whatever gives us a real shot to stay here longer. My 2 siblings already adapted here in Canada so I don't want to waste that opportunity. If there is an unfortunate circumstances , she must find a job here first and apply outside Canada and apply for Exit Clearance before exiting the home country. The exit clearance is our exit immigration policy not Canada. However, If they got AOR , I am also weighing the possibility of options How can they stay here especially my other sibling will graduate from the University next year 2026. My mom is the Principal Applicant and also has a high CLB Score but due to age it would be very difficult for us and also for me.

Just claim asylum, you will get 10 years stay at least. Canada rarely deports anyone so you can stay forever by playing the system.

Let’s not joke and be sarcastic because people may not understand that this is not a valid pathway unless your life is truly at risk. Many are going to face significant longterm consequences because they were incorrectly advised to claim asylum. Although I am also frustrated by the inaction by our governent it is changing people are being deported.

At over 50 even with French the chances of securing PR are very low. Many younger people are also learning French. Your mother’s CRS score is too low for OINP even if they have a draw. Your mother really needs to have a plan B including returning home.

Actually if i can but we are not applicable. My country is Philippines, and Philippines is not a refugee country. Although we are a 3rd world country full of corruption but If We cannot stay here. I am also looking to NZ , Malta , Spain and other countries to gain PR. I will not do that just to stay here longer. If God's will then it will. If not , well we just accepted it and also claiming asylum is also not applicable for us even if I am an ambitious person to stay here. I won't do that and also I don't want to damage the Canadian System just by claiming asylum. I have dreams. In December 24, 2017, I wrote in my notebook that I want to become Citizen in another country and my wish become true to stay here what it's look like living here but , a huge disaster for me and just one day a woke up call for me. I am happy but got depressed. Finding job for me is very hard without it cannot get PR. My option is to have a last chance to stay here by switching a study permit again and get strategized to get pr for all my family before I will be turning 35. I am also not qualify for NOC b job because I don't have NOC b job back home.

It's the best pathway! If you look at the asylum numbers, you will see for yourself. When inept people are running Canada, why shouldn't foreigners take advantage?

Over 5 years the pending went from 80k to 280k. Canada doesn't have the capacity to process these claims even in 20 years and the amount of recourse available after each rejection should pretty much provide opportunity worth a lifetime to stay. So, anyone wanting to stay should just claim asylum and chill.

If you don't wanna go that route, see if you can find a designated employer in Atlantic Canada. It's a direct pathway to PR.
