I have been on a work permit in Canada since March 2024 and currently in the Express Entry pool for Canadian Experience Class. Before that I had been in common-law relationship with my partner for several years, since about 2018. We are still partners, but she is currently in our home country and so we haven't physically lived together for 2 years.
Currently my profile states that she is an accompanying partner, but I am worried that since we haven't been living together for such a long time, we may not be legally considered common-law partners. I can't figure it out from the definition in the Immigration and Refugee Protection Regulations.
In my tax returns and work permit extension applications, I always stated that I have a common-law partner, although I only filed taxes for myself.
I think my case is kind of similar to this, although their situation is different in some aspects.
