I read through the forum though, and feels like that's 100% refusal for me this time with the direction "go under spousal or common-law class".
Booked a legal marriage for November.
I asked a lawyer about this. after submitting "letter of explanation" if there's no response is good thing after they confirmed to received of said document

i'm just wondering what now after medical is done lol time to wait again

Received a PFL on June 24 and submitted the LOE through on July 16 and received the acknowledgement.
Received another PFL (reminder) on Sep 5, stating that we have not received any documents from you and ask me to send the same on or before 05 Oct. and LOE submitted through webform and received the acknowledgement.received the acknowledgement.

It's been just 20 days since we submitted.
I only see 3 realistic scenarios now:
- we get a refusal letter and resubmit under family class after getting married in November (same package with updates of forms, new PCCs, some more explanation)
- we don't get a decision before the end of November and hence we need to notify IRCC about our legal status update (and possibly get re-assessed as a family class)
- SOMEHOW our explanation is enough, we get approval and just spend amazing time on vacation before flying to Canada together :)

The officer said there is no concern that the relationship is genuine, but we do not meet the definition of conjugal partners, specifically because we also mentioned that we are planning to get married (we did mention that, as well as the fact that I proposed).

So we're sticking to the plan, goodluck to everyone waiting, and see y'all in the November thread haha :)

Were you specifically asked to summit your PFL through webform or Gckey account?

It might be the reason why they didn't receive it the first time you sent it?

That's sad, but not the end of the world
What I find important is that there's no concerns about our relationship which is specifically highlighted in the letter. So seems like it should be a faster process when we re-apply, given that we are effectively just addressing the issue (wrong class, we can get married and will do so).
 
Hello everyone!!

Just wondering if anyone has any insight into how long applications are taking for processing in the New York office?

We did medicals and biometrics back in June. We received Eligibility for myself (sponsor) on June 4 but since then, there have been no official updates in the tracker.

We did receive a letter from our consultant, dated April 19, that our file was moved to the New York office.
