Hey Experts,

my situation is as follows, and i hope you will be knowledgeble enough to advise me.

My father had applied for refugee status in Canada from 1997 too 2003, since that time I had gotten my high schooling done and also worked for 1 year continously, unfortunatly, our case got rejected and we were sent back to our home country in August 2003. Its been over 6 years since that incident and now i would like to reapply (as a principal applicant, my father was the principle applicant for the refugee case) as a skilled immigrant as i believe i have sufficient experience and skills to be accepted under this visa.

my question is:

Can I apply as a skilled immigrant? or will my past history will have any bearing on my case?

Hi Sangha,

Your case is delicate. I believe things like this you need to consult an immigration lawyer. I think it is hard for ppl here to give any inputs....most of things shared/inputs here are very generic in nature...

hope consulting a lwyer you will get positive answer.

I also suggest not to get in trap with Immigration Consultants.....they will very easily say that you can get PR just to get their fee......
 
I think you need to find a way to obtain a waiver for the deportation order from the Canadian Govt. before you can apply. Once you get this pardon or revocation of the deportation meaning you can travel on visitor visa to Canada, you are then free from the previous limitations.

That's my opinion though maybe PMM, Leon etc might have better advise.

Regards.

1. You can apply, if you qualify, note that your work experience in Canada won't count as you were a refugee claimant.
2. You will also require an ARC (Authorization to Return to Canada) which will cost you an additional $400.00
3. If CIC paid for your return to your home country, that will an additional $1500.00

I must say, I am pleasanty surprised with all the responses that i have gotten concerning my query.
The advices I have gotten has given me some hope and guide as to what could a possibility for me to return.
