Nawalan ako ng status ng april kaya I have to go back here in phil with my canadian child now that my husband lmia is approved, Pwede na ba ako mg apply ng trv? Wala kming properties, nor travel history pero ng work ako sa dubai ng 3 years yun lng. May chances ba ko na ma approve? Need your advice.

I was out of status in canada that's why I have to go back in philippines with my canadian child now that my husband lmia is approved, Am i able to apply for trv? I have no properties, nor travel history but I worked before in dubai for 3 years and I think that's not travel history. Do i have chances to get approve?Need your advice.
How long were you out of status?
Is your husband on a work permit? Is he planning to apply for PR?
I’m not so familiar with this, so someone can correct me if I’m wrong, but as far as I know, you can probably apply for a spouse open work permit assuming your husband is on a work permit. If you are applying on a plain TRV, you will likely be denied. This is also assuming your being out of status doesn’t affect the decision much.

My last day in canada was april 8, I booked a flight going home with my child april 8 as well.
Yes I can apply for open work permit but it takes few months to process it. And also my child birthday is august 30 that is why we want to go to back to canada and spend my child birthday there. You think it is going to be denied?

It’s ultimately the visa officer’s opinion that matters, but based from what I’ve seen here, your profile is the type typically denied for a visitor TRV: spouse in Canada, child is Canadian, no short-term travel history in developed countries, and overseas Filipino worker experience in Dubai. But I have been wrong before, and a few people do get lucky with a well-prepared application. You won’t know unless you actually apply.

You can apply any time but I strongly suggest you take the time to read on this forum on how to make a successful application given your circumstances. And then ask here if you have any more questions. But please, research first.
He is under restoration, I think it is implied status. He just got new lmia. Can I apply trv now? or I have to wait for his work permit?
IMO, it is best to wait until he has an approved status i.e. he gets his WP. This is also because, if your TRV is approved, the validity would be until the expiry of his WP.
Another point:
I recommend you don't give the purpose of visit as wanting to celebrate your son's birthday because this is not normally considered as a compelling reason to visit.
IMHO, it would be best if you apply for SOWP (after your husband gets his WP) and not for a TRV
But SOWP takes a lot of time to process. So do you think if I apply trv it will get denied?
As bellaluna has explained, you have slim chances for a TRV approval + your husband is currently out-of-status.
It's a choice between processing time taking longer for a SOWP.... or a TRV refusal and then having to start all over again. Your call
