Ola ,
i overstayed in Canada by 10 years and have had a common law partner for 14 years .
We have 3 children born in Canada .1 deceased

I left on my will To take care of my I’ll mother and had no problems exiting .i am applying for Outland common law application in Manila .
My question is -
can I return on a trv ? Id like to attend to my special needs child graduation and come back here with him the rest of summer and back again for school in sept ? I attend to his specialist appointments in Canada

For common law - Outland Should I check residing in Canada as I’ve lived there for more than. 15 years ,

Thankyou for your feed back

If you are a citizen of the Philippines you won’t be able to get a TRV after a 10 year overstay although you can try. You’ll have to wait until you receive your PR through sponsorship so it will. Mean an approximately 1 year separation after you apply. No you are currently residing in the Philippines since you will remain there during your application.

Why do I have to wait for one year to apply for spousal Outland application ?

canuck78 did not say you have to wait a year.
What she means is that the application will take approximately a year. Your chance of coming back to Canada without PR approval is slim so you may need to be away from Canada while the application is processed, again which takes about a year.

Your Canadian child can return. You have virtually zero chance of being approved for a TRV to return and will need to wait for PR.
