Hello, I am applying for my husband who currently is living in the states. He will be coming to Canada for 5 months the question i wanted to ask was is it possible to apply for a open work permit while he is here? Which application form would i have to use because he will be returning back to the states after the 5 months The in Canada application or outside Canada application for permanent residency application ?

There's really no option that matches what you want to do.

If you apply outland, there's no open work permit available.

If you apply inland, he will be given an open work permit four months after the application is submitted. However he has to be in Canada when the application is submitted and is supposed to remain in Canada while the application is being processed.

There's really no option that let's you do both.

The only other option would be if he is age 30 under, he could apply for SWAP. He'd have to register for school courses though to qualify, which is kind of a sneaky way to do it (unless he happens to be in school or a recent grad). It's not worth it for 5 months, better to save some money and have a vacation if staying for 5 months is his only intention.

He has a green card in the USA so does that mean that he would have to give that up in order to get a work permit in Canada?

I agree with Aqua. If his intention , for now, is staying for 5 months, it not worths it and save money could be the best solution.
What you want is what most of people want, but it's impossible.
Applying inland to - maybe - get a work permit, leads the whole process to take 2+ years.
