Applying for PR while visiting

Hi, my brother is here with a visitor visa, can he apply for PR while he is here and what are the steps to take?
I have looked on the web and called the office but nothing clear, could anyone help me please?

If he qualifies under some immigration class, he can apply no matter where he is in the world but the idea of getting the PR while still on visitor visa in Canada are minute. Most immigration classes take at least a year to process. As a visitor, he can stay up to 6 months but not work. He can apply to extend his visit status though.

As to finding out which immigration class he should apply under, you have to look at the cic website, look at each of them and determine which ones might be possible.

We were thinking to do it under the family class, will this work? i still don't know the steps to take, is very confusing this process. I will extend his stay, we are trying to do it now that he is here and not wait for him to go back and applying from there because he will need to reapply for a visa again, we will do everything legal and the right way, it will save us headaches later. Could you help me please?

Family class? You want to sponsor him? How old is he? Are your parents living?

Under the federal system, you can only sponsor a brother if he is under 18 and an orphan although if you have absolutely no relatives in Canada and you are not married and you have no relatives alive in other countries that you are allowed to sponsor such as parents or children, you may sponsor one other relative which could be your brother.

Apart from that, if you are living in Manitoba or Saskatchewan you could sponsor an adult brother if both of your meet certain requirements.

However, if your brother is an adult, even if you can find a way to sponsor him, it will not happen fast.

Yes, family class, he is my brother, he is 25 and my parents live, if this is so hard to do, would you recommend a different way?

Do you live in Manitoba or Saskatchewan? If yes, then you still have an option to sponsor him but you need to have money and he needs to have at least a 1 year degree etc.

Could you find him a job? Almost all of the provinces have provincial nominee programs where an employer can sponsor a skilled employee for PR. It still may not happen fast. If you can get the employer to apply for a labour market opinion for him, he might be able to get a work permit and get his immigration later but sometimes labour market opinions are not approved, the employer has to prove that no Canadians want the job. Doing a job offer and sponsoring through PNP is easier. Still wont be fast though. Easily a year or more. However, if he gets the PNP nomination, that takes some months, then he could apply for a work permit for that employer without needing a labour market opinion first.
