Hi,

We intend to apply for PR outside of Canada.

We are an Australian and Canadian living in a common law partnership outside Canada.

Can we apply under common-law partnership while both of us are not currently living in Canada?

If there is already a topic about this point me in the right direction.

Thanks

Rodger

Yes. This is perfectly normal and is called 'outland spousal sponsorship'.

To be classed as 'common law' you must be able to prove that you have lived together as 'man and wife' for a continuous period of at least one year.

Light reading on the subject of outland spousal sponsorship here:

How long your Canadian sponsor has lived outside Canada is not relevant, only to the extent that she will have to 'prove intent to return to Canada' with you if / when your application is approved. I managed this despite not living in Canada for the last 45 years!

For 'official' reading on sponsorship, start here:

"Man and wife"?

To be classed as common-law, a couple must cohabit in a conjugal relationship for at least one continuous year.
