Hi there,

I am a student that just graduated and I am applying for a PGWP. I skipped one semester due to a collapsed lung so there is a possibility that the permit might be refused. All in all me and my wife also considered for a long time applying for a spausal sponsorship and we are days away of finishing the app.

My question is; Is it possible to send the spausal application while I am transitioning from student to pgwp with “implied status”. And, if I were to apply and mid application, my pgwp was refused, What would happend to the spausal application?

My status is still valid but will definitely expire before I have a decision on the PGWP.

You have to wait for PGWP before you can apply for spouse open work permit.
 
You have to wait. You need be employed in a NOC A,B or 0 job, submit employment letter, have at least 3 pays stubs and then you can apply for SOWP.

If the principal foreign worker is the holder of an open work permit (for example, a post-graduation work permit or a working holiday work permit), IRCC cannot assess the skill level based only on the open work permit, and the spouse or common-law partner applying for the C41 exemption will need to attach proof that the principal worker is employed in an occupation in skill type 0 or skill level A or B.

The spousal applicant should submit all the supporting documents, including

  • a letter from the principal foreign worker’s current employer confirming employment or a copy of their employment offer or contract; and
  • a copy of the principal foreign worker’s last 3 pay slips.
