I've been looking into becoming a permanent resident, but can't seem to find the answer I am looking for. ???
I am a Dutch citizen, currently here on a IEC Working Holiday Visa.
I first came to Canada in 2011 on a IEC Young Professional WP. I worked for 6 months, but NOT in a NOC 0, A or B level job, so I know that time will not count for the 1+ year work experience I need to qualify for CEC. In November 2011 I returned to the Netherlands.
I decided to get the other IEC WP (Working Holiday) and came back to Canada April 19th 2012.
I currently am working fulltime (NOC 1225) and want to continue to build a future in Canada. I have a great job, met a great guy, have a beautiful place to live, drive my own car and am definitely not a burden to the Canadian economy.
My employer unfortunately cannot get an LMO for my position, so I know I will probably have to stop working for them when my visa expires (April 18th 2013). Now my question is:
Can I apply for an extension (even though the chances are it will be rejected) and remain working at that company on "implied status"?
I can't find a helpfull answer whether implied status also counts if you are on a IEC WP, and if that time can be counted towards my 1+ year experience.
I need those extra couple weeks to get to the 1+ year skilled work experience in Canada in order to apply for CEC (I started my current job May 14th 2012).
Or do I need 2+ years since I didn't go to school here?
Most important to me is that I do not jeopardize my future in Canada by doing something illegal, or something that the CIC can use against me in the long run because I really do want to stay in Canada permanently.
From all the info I've gathered in the last few months, I now am looking to follow these steps:
1) apply for an extension of my IEC WP
2) work until mid-May to get my 1+ year skilled work experience
3) withdraw the WP extension application
4) leave the country and come back on a TRV / as a visitor
5) apply for PR through CEC, and wait in Canada until I get PR or am allowed to work again
Is this a legal way and will it not ruin any chances I have of PR in the future?
Also, could I apply for PR through CEC BEFORE I have the 1+ year experience (apply now, though I won't have the 1+ year until mid-May)
I always have the option to get PR through spousal sponsoring (am with a Canadian citizen who doesn't want me to leave Canada
and is willing to sponsor me), but I would like to do this 'on my own' if possible.
