had applied conjugal visa after my tourist visa application got denied since my partner need to undergo operation last january so that will be there in time of his operation..after that he went here in the philippines to visit me and decided to applied under family class sponsorship..will there be a conflict on our application?
 
The more failed attempts the applicant has to enter Canada (or other similar countries), the worse it looks. One attempt will be fine, though, especially given the reason.
 
i think it depends...if u applied for tourist, visit, work visa before u met ur partner and really tried to enter canada with no success then it might b a red flag now....but u applied stating that u go to visit him, b with him during surgery and he invited u, i think it's ok, u could use it as proof for the relationship...say that u tried to visit him and could not, give the file number and copy of the application if u still have it

in our case, we got tourist visa refusals enough times but they were all cuz we just wanted to go and visit my family together...he never had any intentions of moving or visiting canada before we met; i refuse to believe us wanting to spend my mom's birthday or holidays with my family in ca would raise a red flag

just don't leave anything unexplained!! good luck preparing!!

I have the same situation. I am in a common-law relationship with my Canadian citizen partner since 2007. We've been living together outside Canada since 2007.

October of 2007, we decided to apply for TRV to visit our common friend in Vancouver. Our plan was for me to visit Canada and my partner to follow and get married their so we can have a strong evidence/proof to supplement our permanent residence visa application on my return home. Unfortunately, the TRV was denied and we were very disappointed.

Fast forward to 4 years, February 2011 - My partner submitted a famlily sponsorship application under common-law relationship. We submitted more than enough proof to show in the past 4 years that we are in living in a common law relationship. However, we failed to indicate in our application as history that we previously filed a TRV application and was denied.

Will this somehow affect our PR application? Currently, we are on the last stage of the PR application. The sponsorship was approved and CPC acknowledged the Rights of Permanent Residence Fee. My passport was already forwarded to the local embassy. However, no latest information receive in the last 4 months the application was forwarded to the local embassy.
 
You are supposed to indicate on your application that you previously applied for a TRV and were denied, The visa officers check the records, and will see you applied before, so they will wonder why you did not admit it. You can be denied for something like this.

I suggest you send a letter to the visa office in Manila telling the visa officer about this previous TRV application. Include your file number and both the applicant and sponsor's names and birthdates.
 
yes it's better to tell them before they question u why u did not...however, many people did that mistake and nothing seemed to happen; but why would u take an unnecessarry risk?

as a side note, we r common law since 2008 :) one year after u and us too were thinking that maybe if we manage to visit ca together we would get married there with my family and friends :) we were planning to come back, so their reason of refusal was not justified; i guess it was not suppose to happen at that time, and so we patiently wait for the day when it will happen; best of luck!! :)

@canadianwoman, missmini -- thank you for your suggestion. We made a letter explaining the previous filed TRV application and it was refused. We also stated in the letter that we overlooked this part my personal history by mistake.

Tomorrow, we will go directly to the embassy to hand over the letter or put it in a drop-box. Do you think sending the letter will help in our PR application? We are very worried and afraid it may lead to refusal.

What do you think?? We really need you advise here... Appreciate the help.
 
If you didn't tell them about the failed TRV attempt, the visa officer would most likely find out (they can easily check if you have applied before), and then that would be a problem. The visa officer will see no reason for you to have not mentioned it, except a bad reason. It would be seen as one reason to refuse the PR application.
So sending the letter explaining about it before the interview is the best option now. Just explain why you didn't mention it before.
 
don't worry they don't refuse cuz u admitted something true...they could if u did not, they could say u lied for a reason even misrepresented urself but maybe that's too harsh since it's a common mistake

if u have the file number from that visa application, write it down; u could also include a copy of the refusal letter (if u have) and even the 1st page from the forms (where it says who u r visiting) (if u made a copy of it)

i wasnt able to include the copy of the file number of my visa application for visa that failed..but i have included it in the form in some part of the questionaires in application paper..is that gonna be ok..i had told them that had tried to apply for tourist so can be there for his operation..to care for him since hes alone..and he cant take care of himself after the operation..will that gonna make any negative result..
 
no! they could find it by themselves if u gave the file number, probably even with ur name only....in our case i want to make sure they know cuz all these refusals made him not able meeting more of my close friends and family...hence i attach these letters as proof of that (so they see that we really tried ;) )

also don't compare urself too much with everyone else!! each case is different, each embassy has a different way of processing....good luck!

We went to the canadian embassy and submitted a letter explaining the failed TRV application and why we overlooked this information in the PR application.

I hope the VO will see this information and understand the we are doing our best to be transparent and honest in our PR application.

Question, We sent the letter of explanation concerning the failed TRV last week, almost 4 months after we submitted the passport, appendix A, and personal history. Do you think the letter is too late? ecas status is still "application received". Do you think the VO will consider the late letter?
