Hi,

My wife and I had applied for canadian immigration in May 09 and left immediately for India.This movement was due to work related aspect.I got my approval from Nova Scotia in Sep and was instructed to send my application to Buffalo office.

It would be another 3-4 months before I get to travel back to US.During this period,my validity of 120 days will expire.Please let me know a way forward on this issue.Should I inform the canadian consulate that I am in India and request for some extension ?

Should I only send the documents currently available with me and send remaining documents (to be obtained from US) when I reach US ?

Kindly let me know.

I have not appointed and representative for my application.

I would say ask them for extension but I think I have seen a senior member on this forum say that they don't give such extension. Do you have the bulk of your documents missing or only one or two things?

1. It is unlikely that Buffalo would issue an extension.
2. If they receive an incomplete application at the 120 day mark, they will make their decision on what was submitted, which if the application is incomplete is a refusal
3. As an aside why did you pick Buffalo rather than Delhi if you were leaving the US?

I think the OP is going back to the US. Would the best course of action (if the OP cannot get the documents on time) be to re-apply to Sydney while sending a mail to Buffalo to cancel the old application?

Yes, that way he will at least get his processing fee back. If he can send a complete application by the 120 day mark. See:
"A) Requests for extensions

The FSW application kit [IMM EG7000] informs applicants “visa offices are strictly enforcing the 120 day rule and will not provide extensions.” In addition, applicants are informed clearly and unambiguously of the documentary requirements and the timeframes for submissions to the visa office. The FSW kit states:

Consult the Visa Office specific requirements now to determine what documents you will need to provide ... If you are not prepared to submit full documentation to the Visa Office within 120 days do not apply now.

Applicants are given notice from the outset that if they are not prepared, they should not apply. Applicants who follow this notice should be able to meet the deadline.


Nevertheless, some applicants will request extensions. All requests must be properly considered, documented in CAIPS notes and answered. Visa officers must bear in mind, however, the importance of the 120 day deadline in order to manage these cases efficiently.

Thanks everyone for your opinions.I will send the incomplete application and mention about the missing documents.Will leave rest to heavens!!

Due to unavoidable circumstances,I had to leave US in 10 days' time thinking I will be back to US soon.But,I am still in India and hence this situation.

Let's see which way the elephant turns.
 
Hello,

An update on my case.Since it was a close shave,I did not send my documents.Buffalo office has closed my file.They have informed me of refunding the fees. I shall try to apply once again from US.
