Dear fellow forum members,

I had a twist in my application which may slow down my application little bit but for a good reason.

I recently did my medicals but asked a month extension for my spouse since we had a baby boy born after a cesarean section and she is advised not to travel for some days.

When I sent an email to inform that we are expecting a baby and my work permit expires on September 7. they asked me to send my baby's passport and birth certificate within 60 days. In the email that I send I did not say the date that our bay expected. The request from Buffalo VO reached before the day baby was born. After a week itself, I got baby's passport and birth certificate in fast track mode and today I received my baby's medical which I couriered to my home country . My spouse and baby are planning to do their medicals next week. The letter does not say anything about my spouse's medical extension but I assume that they granted an extension.

My file will be little delayed but I am happy.

Dear seniors,
Last month Cairo VO asked me to issue new separate passport to my daughter ,Because I had sent a common passport for my spouse and daughter. Therefore,I issued new separate passport for my daughter and I sent a copy of this passport to cairo VO.As aresult the last common passport of my wife and daughter automatically became to my wife alone.
But,Today I received second e-mail from Cairo VO to confirm receiving new copy ofseparate passport of my daughter ,and did not receiving new copy of separate passport of my wife. So,the asked me to send new passport copy of my wife.....!!!!
I'm wondering and surprise now ...because Cairo VO need more new passport copy....It does not make a sense for me because my wife already has separate passport now after last separation.
Please advise...

This is a copy of E-mail that I received today from Cairo VO:
Good Morning,
Further to your application for Permanent residence in Canada , please note that we did not receive the passport copy for your wife. In order to continue processing of your application, please provide us with required new passport copy for your spouse within three working days .(That includes no. of passport, issue & expiry date, and full name).
Kindly note that we only received the passport copy for your daughter.
Thank you

Dear Friend,

Obtaining a new passport for your wife is an easy job especially if the remaining time to passport expiration date is not long enough.

So I advise you either to obtain a new passport for your wife in order to clear up the separation issue or write an email to Cairo VO explaining the situation.

;D Landing will come by and by. One however has got to be a bit proactive don't you think? ;) I thought what better way to start by taping into my loyal constituent on the forum. With all the waiting and the crossing of fingers and toes, there has got to be a handful of niggling joints and sore muscles when we eventually make it to Canada ;) We can't promise travel allowance but every 4th therapy session is on us. As a token of your loyality. You won't get that anywhere else ;) :D

I was just going to say that with the many facial expressions the smileys up there allow us to put up on the forum, it's a pity we don't have plastic surgeons on board too to help us correct the settings after going through them for months...
But come to think of it, there could be plastic surgeons in 3111 ??? ???

My husband was able to order them from here
http://www.cic.gc.ca/english/department/atip/requests-atip.asp
but I think this as to e doe by someone in Canada.

It does not have to be you, but it can be someone you know well and trust and they can order the CAIPS notes on your behalf.

If you do this it is only $5 and they have to send them within 30 days of receiving your request, as that is what their freedom of information laws require.
If you go through one of the commercial agencies who will offer to order them on your behalf, they will charge you more money.

we've ordered CAIPS through commercial agency, it will take about 30 days to receive them, so hopefully by the end of Sept or begining of Oct we'll know something. :-\

I wish we will hear something from London before that time
::) :'(

Dear friends!

I m a post june 26/6/10 Applicant. Current status is RBVO. I have recieved below email from London VO.

Proof of relationship to your relative living in Canada and evidence that your relative is living in Canada:

1-Provide official, objective, legible documentation to prove that you are related to your relative. Documents should include birth certificates and marriage certificates. The certificates must state the parents' full names. You must provide certificates for each person that links you to your relative. All documentation must predate your application. Affidavits prepared for the purpose of your application will not be considered conclusive evidence of your relationship.

Your defence:
In actuall, i have claimed points of adaptibility for my Spouse's Maternal Uncle.
Since both my Wife's Mother and My Mother in law's Brother[Wife's Uncle] were born before 1950. at that time people were very reluctant to make bc. even if they have made bc, due to frequent migration within the city/state they have lost their birth certificates. Therefore i sent following documents to CIO.

1.Wife's Birth certificate.
2.Wife's Mother Marriage certificate(showing common parent with her brother)
3.Wife's Mother's Brother's Marriage Certificate( Showing common parent with her Sister)

I dont know why VO has sent me and requested me for these documents since i already provided Marriage Certificates instead of Birth Certificates

Hi Linksalman,

Very sorry to hear about the request for the additional documents and additional STRESS for you. ??? ???

Don't worry, you are a genuine case and you just have to fortify your documents with solid proof.

I have just selected the portions of your post that needs attention/valid argument.

1.All documentation must predate your application.
2. Affidavits prepared for the purpose of your application will not be considered conclusive evidence of your relationship.

What you should do:
Try to get affidavit for both your wife's mother and uncle...this is the only option you have.

How do you justify:

Even though CIC has clearly mentioned that all docs should be pre date your application, you still will be including the "Affidavit for Birth" which post dates your application because of the following reasons:

1. The "Registration of Births and Deaths Act, 1969" came into effect only in 1969 and prior to this period there was no Office in place to record such events and since both your wife's mother and uncle were born in 1950, no record was kept in any office. DO NOT MENTION- - at that time people were very reluctant to make bc. even if they have made bc, due to frequent migration within the city/state they have lost their birth certificates. This is a very vague answer which will not satisfy the VO.

You can attach a copy of the Act. The link is as below:

http://delhi.gov.in/DoIT/DES/Registration/ACT.pdf

2. Why did you not attach this earlier?:

You strongly believed that the Marriage certificates would suffice the need to prove the "Relationship".

3.What about School records? (I am just suggesting some options).

a) If they went to school then birth records might be available but will not be the official records from the Municipality Corporation.
b)Can not be recovered, even if available, because they have grown too old and have changed cities.
c) Records are lost - You may have to provide a letter from the school validating this.

You may have other valid options too.

Hope this helps and you get time to prepare the Affidavits...and hope this works out for you.

Good luck Salman :)

Mitali

NB: I hope you are from INDIA (huh...just realised that...how stupid of me :-[ :-[) If not then I will try to search your country...let me know.

Additional point: Try to get a "Non availability of Birth Certificate" from the Municipality, which will help support your document.
