I am also applying at Buffalo and I am concerned about Police records as mine were 3 months older when I sent them with my file to CIO. Could you please tell when your police certificates were issued and does the visa office ask you for new ones?

I received a letter on July 21st in my address in Ottawa, Canada which was posted from Fort Erie, Ontario, Canada on 30th June 2011.

Buffalo VO uses Post Box address in Fort Erie, Ontario, Canada to send communications by mail to all IN CANADA applicants. I have used this mail address to renew my visa several times before and BUFFALO VO has inclued this address in their mailing address.

Let me tell you what is the mail that I received after 22 days that is send from same province in Canada.

Mail from Buffalo goes like this.... We have now completed the initial assessment and expect to finalize your application without a pertsonal interview


The letter contains MEDICAL REQUEST FOR ME AND MY SPOUSE and REQUEST FOR RIGHT OF PERMANENT RESIDENCE FEE

I am really surprised. its was a dream for all of us and now it has been shattered with no fault of us....
Can any one please help me as to what can be done to correct this error? if they refuse the visa, they should have returned the 1400 dollars they deducted, but they have not done that. I am not worried about them, but would like to go to anywhere to correct this error......

Hi noolan,

Several people in recent past have received NER (negative eligibility review) by error and they were able to overcome that by re-submitting their paperwork and clearly demonstrating that they were eligible for points claimed.

CIC is rather effective and fast in remedying outcomes such as yours. Do some research on this and other threads, I don't remember all those posters by screen-name , but I did read about at least few individuals posting on this forum who were initially refused but subsequently approved for further processing.

Good luck and try to IM or ask older members here, including qorax, Wayne and others.

congrats! its a great news though it was long past due.
I hope buffalo moves quicker now since medicals are being processed faster and sent to buffalo in about 3-4 weeks.

And you shouldn't feel alone since most of the immigrants/international students or professionals are like that in the initial phase. We all have gone through these phases and many of us have not gone home for quite a few years also. Things will change after you get PR and when your wife joins you.

Well Congrats again and wish you good luck with your future processing.

Hi noolan, the same situation happened with me.
They will not return you $1400 as they have refuse your application, the 1400$ will be refunded ony if your category gets full.
I have also asked for the review and submitted additional documents...
Any update from them?
This was happened on 27 june to me.
i sent doc to them on 5th july and they received on 11th july.
Still waiting for their reply.

Hi saratracy,

When I send my application the CIC guide was not updated and it was asking not to send the Police Clearance certificate. But I ignored that part and I did send my police clearance certificate since it took me several days to get it and when I initially started the guide was asking us to send all documents to CIO.

My police certificate was issued in August 2010. They did not ask me a current one.

The recent letter with MEDICAL REQUEST AND RPRF is clearly saying that they don't need any additional documents and they have waived my INTERVIEW.
