I agree with canadajimmy. he has done it before..

i did have bad experience with CIc in several occassions and my friends too and all those occasions either I wrote back asking clarifications or appaeled their decisions.

You can do that by lawyer or by yourself.

If you do by yourself make your point in a polite and gentle not blaming your agent or your visa officer for the fault one by one with supporting documents.

they did inform me in march, 90 days after I got PER.

in the letter that they wrote to me when my ECAS was showing medicals received at on etime erroneously, i took that as an opportunity asking them clarifications on medicals recently (( i did not do medicals after August 2008 - the year I entered Canada)).

I had posted that in some post here in this thread.

They said to me it will take a minimum of 30 weeks to open up the file and create a new file number from Visa office and the file number in the PER will change when they create a new file number in VO buffalo.

But I will like to take united decision by all buffalo applicants to bring forward this descrepancies

The Point is that.

1. Most of us are in canada and proved that we are admissible to canada before.
2. Most of us have canadian experience.
3. Most of us are already contributed to canadian economy and society
lot other points................................
let's name it and draft it as a petition and i can ask for an appointment with Canadian Citizenship, immigration and Multiculturalism minister.
Let's make an attempt and submit it. may be we will succeed.

Its a case of failed ER at the VO ... I had a total of 4.5 yrs exp .. more than 2 yrs as a Restaurant Manager (NOC 0631) and 2 as a Food Service Supervisor(NOC 6212) .. but my consultant wrongly gave the NOC code as 0631 for both my jobs ..

my application was assessed based on 0631 for both my jobs . The Reference letter that I submitted which relates to 6212 was even assessed based on 0631 .. My consultant never cared to put in the correct NOC code of 6212 where I worked as a supervisor, instead he gave the code there as 0631 .... and the application was rejected stating that employment letter do not indicate you performed the actions described in the lead statement for NOC code 0631 (Restaurant and food service managers) for the job i did as a supervisor . I was in fact awarded 17 points for the job that I did as Restaurant manager .

The explanation above is vague .. will post the exact details and wordings of the rejection letter tomorrow..

Sorry to hear this. Since you know clearly the reasons, do quickly correct and resubmit. I am not sure which way is the better one:
(a) Completely fresh application
OR
(b) Reply to letter but with corrected application form explaining error in NOC code (and apologise too).

Perhaps some seniors can provide input too.

So sorry to hear about it.

I suppose your course of action would depend on the basis for the rejection, as I believe of the 2 NOCs mentioned, only 0613 is amongst the list of 29 demand occupations. I can off-hand think of the following 2.

  • That because your consultant had added the duties carried out under NOC 6212 in your overall job scope, it had appeared to them that you do not perform sufficient works related to NOC 0613; or
  • That the 2 years you have under NOC 0613 would not give you sufficient points to meet the 67 required. (I know that there are a couple of threads here debating on whether the number of points awarded with regards to Work Experience is related to the overall number of years, or only the number of years you have on the demand occupations.)

If the former, then I would think that you should appeal on the grounds of the mistake made by your consultant. After all, you have nothing to lose. If the latter, and unless you have knowledge of precedent cases in your favour, you may require the help of a lawyer.

On the second suggestion... You need to have only one year experience in the 29 occupations, other work experience can be in NOC O, A or B ... please carefully read the guide in cic web
