Thanks Wayne ..... Didn't have that idea, as it was nowhere mentioned. That means CIO have to modify / expand the meaning of Cat 2 under their Instruction Guide. They should mention that LMO /TWP is acceptable ..... I remember the case of our good friend 'Mr. BOAR' - CanadaJimmy ...............8) 8) ............. Thanks again.

Yes That is the same message I get. I got My PER on 23rd November, No information available yet.

Keep on checking and update the forum. Since Your VO is different then mine, you never know which VO is faster.

If you are referring to the ECAS system, even May/June applicants have not been able to access it. I think the information is manually entered into the system and CIO have not been doing this since May.

So unfortunately we are not going to know for sure what happens next until someone hears from visa office. We *think* visa office will send an AOR out once they have received the paper file and have started processing it (security/background checks etc). But until the first person report that's happened we won't know for sure.

I suspect from hereon he timescales are going to get somewhat visa-office specific. Some visa offices are simply less busy than others. London seems to be one of the slower ones, since they took onboard thousands of applications from Pakistan they now have a lot more applications to deal with.

Will be interesting to see whether visa offices have a separate team to process the post-June-26 applications.

Changes since when? Please be more specific?

Regarding PCC:

1) Original instructions June 26 2010 = you MUST include PCC with your application

2) Amended instructions August 2010 = DO NOT include PCC with your application, visa office will ask for them when ready

3) Further amended instructions November 2010 = you MAY include your PCC with your application, but you may also omit it and wait for visa office to request it.

So currently you can choose to submit or omit it with your application, but CIO recommend including it if you are able to.

Looks at least reasonably clear:

"If you have an offer of permanent employment from a Canadian employer, it can improve your chances of having your federal skilled worker application approved.

Depending on your circumstances, the requirements for a valid offer of employment are different.

1) If you are currently working in Canada:

* your current employer must have made an offer to give you a permanent job if you are accepted as a federal skilled worker, and
* your temporary work permit must be valid both when you apply for a permanent resident visa and when the visa is issued.

In addition:

* your work permit must have been confirmed by Human Resources and Social Development Canada (HRSDC) through a positive labour market opinion or
* you must be in a category that is exempt from an Arranged Employment Opinion

in order for your offer of employment to be valid.

2) In all other cases:

You must not be working in Canada and you either

* do not have a valid work permit or
* you have a work permit, but your circumstances are different from those described in the first example.

In this case, the offer of employment is valid if your prospective employer

* has made an offer to hire you on an indeterminate basis if you are accepted as a federal skilled worker, and
* has obtained a positive Arranged Employment Opinion from HRSDC

and you

* meet all required Canadian licensing or regulatory standards associated with the job.

Note: You cannot arrange for an HRSDC confirmation of a job offer. Your employer must do this."


So, from the above:

Case 1 = TWP/LMO, apply from within Canada
Case 2 = AOE, apply from outside Canada

Both are Federal Skilled Worker, Category 2. In CanadaJimmy's case CIO made an error, in that the TWP proves that his job is approved by HRSDC, but CIO overlooked this. They since reviewed the decision and granted him his PER.

So basically Temporary Work Permit with positive Labour Market Opinion OR Arranged Employment Opinion means you can apply as a Federal Skilled Worker under Category 2.

I just need clarification in respect of Application Forms, I hope seniors will enlighten me with their views / suggestion

- Is it Okay if we can Partly Fill the Form on Computer and Partly By Hand using a Black Pen, because some of the fields are not large enough to write the Complete details, Moreover the Font Size is also not equal for all the fields (Questions), for some it is very small and for other it is large.

- Does Filling by Hand with a Black Pen creates any negative impact because in the light of above mentioned, we may have to squeeze the handwriting to fill in some details in reply of some questions

- Can we use the initial / Acronym like, HSC (for Higher Secondary School), B.Com (for Bachelor of Commerce) MPA (for Master in Public Administration) because again the fields in respect of these questions are not large enough to write the full descriptions

- Though CIC has asked to sign only two forms i.e. IM0009 1e (Background Declaration) and IMM5046E (Additional Family Information) or is it Okay, if I sing and date on other forms as well, may be at left or right bottom.

- Is it enough to write N/A only in the reply of Main question in respect of question which has various fields / sub questions or do we have to write N/A in each and every field.

- If the children are infant i.e. around 1 year of age, then what should a person write in the question relating to their education, language and height (as they will grow quickly)


I hope these are the questions which might be circling around in many minds, hence your answers will benefit a lot many people, who are in process of or planning to apply soon.
