I'm from Ireland but I am out of status right now as I had sent an OWP permit with my application before my last work permit expired but as it has been sent back I guess that means I don't have anything allowing me to stay here for the duration of the Outland application?

You will have to apply for a Restoration of Status which is to be done within 90 days of your expired work permit. Once you have your status restored, you would likely to be put back on "visitor" status. In the meantime, you would not be able to continue working until your status is restored.

I haven't been working anyway so that's not a problem.
May I ask how to apply for Restoration of Status?
Thanks so much for your input

Restoration of status

You may seek restoration within 90 days after your status as a visitor, student or worker has been lost, because you failed to comply with one or more of the following conditions:
•You remained in Canada longer than the period authorized for your stay (but not longer than 90 days).
•You changed employers or type of work before obtaining a new work permit.
•You changed the type of studies, educational institution, location of studies, or times and periods of studies without applying to change these conditions on your study permit if they were specified on your study permit.

You may still be eligible for restoration if you continue to meet the initial requirements for your stay and have not failed to comply with other conditions imposed.

You may wish to complete an application to apply for restoration of temporary resident status and for a new study or work permit. There is no guarantee that your application will be accepted. On your application you must provide full details of all the facts and circumstances that resulted in you committing the offence.

If you wish to obtain a new study or work permit and restore your temporary resident status, you must pay the permit fee in addition to the restoration fee.

Restoration applies to each family member who has lost his or her status.

An officer will evaluate your request for restoration of status and if approved will process your application for a study or work permit. You will then be advised of any further action to be taken.

Note: You may not study or work in Canada until your application for restoration has been processed.

Fee:

Restoration of Temporary Resident Status (due to loss of status as a visitor, worker or student) - $200

We applied for inland spousal sponsorship in February, CIC received it on February 13th and just this Friday we found our entire application returned to us into our mailbox as we had missed one of the forms being updated during the process of our applying. It was 100% our own oversight and we're so frustrated that we missed it.
Now from here on is my question, have we basically "lost our spot"? Are we back to square one? The letter they sent us had a UCI on it, my question is when we resend everything including the updated form, are we looking at 10 months from now again? Or does the fact that we sent it in February hold any significance at this point? Much appreciate anyone's input....thanks

Sorry to hear about your case. The same thing happened to me about the same time you submitted your application. I was however lucky to get my forms back early. The updated forms were returned within a week and my application approved about ten days later. I wish you all the best.

Thanks so much for your message Marco.
Did they send you a form to return to a specific case officer? Or did you get a letter asking you to resubmit everything?
I am really reevaluating everything at this point and trying to stay positive.
Thanks again

Thank you so much for that information.
I will apply for restoration and am currently considering applying Outland instead of Inland again.

Two of the forms IMM 1344 (Application to Sponsor, SA & Undertaking) & IMM 0008 (Generic Application Form) has an updated version which is JULY 2014.

But when I downloaded the form & filled up on 14th June 2014 , it is still the older version in the CIC website. I just found out in this forum after i mailed our application last 18th June that there is a newer version --- the July 2014!! (i think they released between 14-18 June 2014)

My question and my biggest worry is, are they going to return our apps?? We are only in June 2014 now but by the time they open our package, it will already be July or more and forms will be considered outdated?? :(

What do u think guys?

Two days before submitting our application I came across another web site that had a lawyer's list of top reasons an app package could be returned. One of them was 'outdated form'. Sure enough, checked ours & realized two of them were not the most recent versions. Had to spend $70 for my wife to courier the re-signed forms to me, but appears it was worth it now. Nonetheless, it seems to me very unfair that the ENTIRE application would be sent back just because ONE form was incorrect. For crying out loud, show some humanity & ask for the right one to be completed and resubmitted!!! Brutal.

We also had to redo forms twice and pay for courier. The other problem is the rules are not applied consitently. It seems some officers just request an updated form while others return the package. It should be one or the other across the board.

Well worth it right? Better than everything going down the drain
I really am quite surprised that they returned everything due to this one error, maybe with the huge backlog they have they are quick to kick an application out the door :/

I know...mine seems to be an extreme case. I think I'm going to apply Outland instead! My experience with inland has been so negative, 4 months just to get everything returned and for this reason.

I think outland is a good idea for you too.

I imagine the positive side of this is that you are already in their system somewhere so maybe you will breeze though the first part of the application once you resend.
I'll be praying for you!
