Hi there

I am on a visitor visa which the border agent put the date for JAN 26th.

I prepared my SPOUSE SPONSORSHIP INLAND + OPEN WORK PERMIT APPLICATION package (and due to delay in receiving some documents, i managed to send it out just TODAY i.e. JAN 22).

I sent it through UPS next day delivery - but CIC won't get it till MONDAY i.e. JAN 26th.


In order for my OWP application to be processed, i must be IN status when CIC receives the application.

THE QUESTION:
IF my status expires JAN 26, and CIC receives the application ON JAN 26. Am i still considered IN status or OUT of status?

The REAL question is whether or not CIC will use the 26th as your `official' AOR date (Acknowledgment of Receipt). Unfortunately, you won't know for sure until you receive the AOR letter (if you're one of the fortunate ones that actually receives a letter, since lately...most people have not). Until you have the AOR information, it's hard to say.

But...if you sent it today, why isn't it being delivered tomorrow...which is next day? Did UPS get it after the cut-off time today?

Either way, I'm voting that you WILL still be in-status.

The day the mail/courier arrives, the application gets stamped wirh a date and this is considered lock in date. If the officer opens his application a month after and if in fact it arrives on the 26, he will be in status.
 
I don't think you'll have any problems. During the last postal strike, they *seemed* to indicate that they use the date an extension of stay was postmarked. I wouldn't count on that, but I think I did mail one application for an extension of stay on a Visitor Record on the actual day that it expired and they didn't have a problem with it.
 
You still have time to do an online visitor visa extension for $100 instead of stressing over it.

I thought about that but UPS had already processed the package by then. (i wasn't thinking) The online visa renewal would have made sense if i would have enclosed a copy of it with the PR application.

I sent it via 'UPS overnight' but because i gave the package at 3pm, they said it would be received on monday.

Though i was supposed to send it to CPC-M, PO BOX - I had to send to it the courier address 'Robert speck' address, which is for receiving couriers. So hopefully it WILL be received on JAN 26 (UPS guarantees it )

You actually didnt have to enclose copy of ur online extension with ur PR app. :o
it is more than enough if you just did it. CIC can verify it in their system.

So what did you do ?
 
From CIC:
if you send your application for an extension of your authorization to remain in Canada at the latest on the expiry date of your status, you will be considered in status as a temporary resident (TR) until a decision is made on the application. This is known as an implied status.

An OWP is an application to extend your stay, if sent with your PR.


I called CIC several times, they assured me is not the date they receive it, is the day you send it, ie: your Package is postmarked, the day you send it.

In my Case, I sent the app on a Saturday (Feb 7th), Package arrived the Tuesday (Feb 10th), which was the last Day of my Status, your implied status starts the following day after status expiration (Feb 11th).

The reason I waited so long to submit was that I had an outdated Option C printout, and the newly requested one took more than 2 weeks to arrive.

I sent the app without it, and wrote a letter explaining the cause. (got the Option C the monday Feb 9th >:()

I would not risk sending it the day of your status expirying.
