Application denied - Experts please help

My brother applied under FSW NOC 1114 – Other Financial Officers (application reached CIC in 3rd week of December 2014). Today he received an email from CIC stating that his application has been denied. Reason for rejection is stated as lack of enough evidence to support the role as described by noc. The unfortunate thing is that this application was submitted through a leading immigration law firm in Canada.

Anyway, the lawyer is now claiming that this is a clear error by reviewing officer and is recommending paying a fee to the federal court to consider this case.

Needless to say, my brother has already incurred substantial legal fee for original submission. This rejection has led us lose trust on the law firm's reputation and wonder if they did not do their job well. Now we are contemplating whether or not to trust the law firm's stand on this matter.

Long story short, has anyone gone through this appeal process? Is there any point even considering this route? Any one with similar experience, please comment. Appreciate your help.

the applicant is responsible for all mistakes done by the consultant and cic cant be held responsible.
you have to take legal action against your consultant.
there are lots of fraudulent lawyers/consultants/immigration firms wholoot the money of their clients.

It is perhaps the single most important document of your FSWP application which demonstrates to CIC that you indeed have performed the duties in the occupation you are claiming points for. You can not have your FSWP application accepted if you can not demonstrate enough evidence to support the role described in NOC. The experience letter must be carefully drafted and signed by the appropriate person in the organization you work at. Your consultant should have provided you with better guidance on the wording of the experience letter (and/or other acceptable supporting documents) but ultimately it is the applicant's responsibility to get these documents from his/her organization.

Totally agreed. The unfortunate thing is all employment letter drafts were carefully vetted by the law firm (leading Toronto based firm). The law firm is blaming that its a legal error by the VO and recommending that we should appeal. Ofcourse with many if's and but's. They also indicated that they are seeing an increased number of rejections in the past month - Perhaps a gimmick to get rid of the backlog and focus on Express Entry? We can only speculate.

Is there a way to apply for GCMS notes without UCI or application / file number? The rejection email from CIC does not quote any number. My bro intends to order GCMS notes to see if the chances can be improved incase we decide to go for EE.

nothing can be done buddy, even if u go in courts, as fswp is no more there to accept applications. if u go into courts, ur case might take another 6 to 8 months minimum to get hearing and any decision by court. and it is highly unlikely that court will decide in your favor.....they will definitely support their system and persons.

instead of wasting money in courts and hearings, prepare to apply under EE. only go for case filing if and only if your law firm assures you that court will undo the decision of cic and ur app will be accepted under fswp again. cos if u don't have that guarantee then why wasting so much money again?

don't get depressed or discourage by my opinion, its my personal opinion and not meant to hurt u or ur feelings or plans. good luck.
