Applicant, NOT sponsor leaving Canada when outland PR is in process ?

Hello Seniors and experts,

I am the applicant for PR and being sponsored by my wife. I am currently on LMO based work permit in Canada and my file is being processed OUTLAND in New Delhi. It is stage 2 of the process (After sponsorship approval)

I am leaving Canada for exact 3 weeks in November this year (By that time it will be already 7 months since I applied for PR).

My wife will be staying within Canada and will NOT leave the country since we know that CIC is very strict about residency requirements for the sponsors.

Is it okay for me (principal applicant) to leave the country for 3 weeks and return back to Canada safely without any problems in re-entering ?

My work permit is valid for another 2 years.

Please advice and oblige.

I just want to say something that may be obvious but just in case, if you are not Visa exempt you also need a valid visa to come back into Canada. I once left the country while on a work permit and I didn't know that a Visa was different than a Permit. They didn't let me get back on the plane. Oops!

Thank you so much for your reply. Much appreciated.

I do have entry visa in my passport valid for next 2 years. So that shouldn't be a problem.

Additionally, I wanted to ask something.

I am expecting my passport request from NDVO in approx December this year. By that time I will be in Canada back from my trip.

My question is that since my job in Canada will not allow me to go back to India for passport submission, can my wife (my sponsor) take my passport to India and wait there for approx a month to get visa stamped and bring back my passport????

Can that be done since I can not leave the country for 1 month due to job restrains?

I am asking this bcos I have read that sponsor must NOT leave Canada before I get my PR. Bht is it safe for the sponsor to take the passport for submission out of Canada?

Is it safe for sponsor to go out of Canada at the stage of passport submission or it is still unsafe?

I hope I made my point understandable.

I think the sponsor can go on vacation outside of Canada, they just shouldn't live anywhere else. Sometimes when they're away for too long, the Visa Office might think they're no longer living in Canada, and that's when there's a problem. But if you're still working in Canada and she's going back to Canada after her trip to India, it should be safe.

However, I don't know how the rules for Indian passports work. Is it legal for someone else to carry your passport outside the country? How is that different than sending it yourself? (I'm asking because I'm genuinely curious).

Your wife can travel with you, who says a sponsor is not allowed to go on vacation ?

There is only residency requirement if the sponsor is a PR and not a citizen.

And even if a PR, sponsors can certainly take vacations of 3 weeks at a time outside Canada. CIC will not care.

I want to take my wife with me to India but I am so scared.

For India, the passports can not be shipped across countries by post or mail. It is prohibited.

But if I give it to someone going back home, along with a letter of authorization and the passport request letter from CIC, then it works and no problems are noted.

Is your sponsor PR or citizen? As Rob mentioned, it is just PR that has this requirement.

Even if just PR, it is only problem if the sponsor is gone for a long time (like a few months or more). 1 month or less should not cause problems.

My sponsor is a PR.

And it helps if it is not a prb to leave Canada for abt 3 weeks.

I mean ofcorse she is nt leaving for that long and I read somewhere just now that it is required that the sponsor maintains constant ties with Canada which does not mean that she cant go for a bacation.

Agreed. A 3 week vacation will not endanger the application.
