Not a good news: I got a NER, but not satisfied with the decision.

According to me my points were 68, but they rejected the case becasue they awarded me only 66 marks. They did not award me 22 marks in Education Section, they only awarded me 20 marks and they did not award me ponts for the 2nd gree in Law (LLB). I have 14 years of BA, and 3 years of LLB( Law). I did not know why they did not award me 22 points for my 2 bachelors degrees (BA and LLB).


Very sad and disappointed. I do not know why did they not consider LLB (Law) of 3 years. Please someone suggets.

It is there, read carefully because a lot of people have been succesfull following those instructions:

The Solution

The solution I recommend to anyone like myself, who has received an unfair NER are following steps, based on an idea that popped into my head after putting the phone down on CIC. In the original NER email is a fax number for address changes “only”. Could this be the secret way to send CIO some top priority information?

Address changes should be faxed to (902) 270-3561. PLEASE NOTE THIS FAX IS ONLY FOR ADDRESS CHANGES.

I am in Canada, as the case representative of the applicant i have talked to CIC representative over the phone. The CIC lady were not listning anything and were repeating the same "you cannot appeal the decian blah blah". She was rude as well as did not know anything. And at the end she disconnected the line.

They did very unfair with the application, they did not even tell in the aseesment letter why they did not award 22 points? At least they should tell the reason! vey unfair and disappointed work by Canadian officials.

I do not think..there is any official appeal procedure available for appliant get refusal?

I am not talking about appeal..

1) what i need from them is explanation why did they not award 22 points in education despite the fact the applicant possess 2 degrees and 17 years of education.
2) And I want them to assess the application according to the information i provided with application.

I am planning to write to minister of CIC. i have no other option left if they did not respond me ASAP...........let's see

I would send a letter similar to what you see at the blog that I showed above. There is no harm in doing it if you should have received your points.

I have now completed the assessment of your application for a permanent resident visa as a skilled worker. I have determined that you do not meet the requirements for immigration to Canada.



Subsection 12(2) of the Immigration and Refugee Protection Act (IRPA) states that a foreign national may be selected as a member of the economic class on the basis of their ability to become economically established in Canada. Subsection 75(1) of the regulations prescribes the Federal Skilled Worker class as a class of persons who are skilled workers and who may become permanent residents on the basis of their ability to become economically established in Canada.



Pursuant to the Immigration and Refugee Protection Regulations, 2002, skilled worker applicants are assessed on the basis of the requirements set out in subsection 75(2) and the criteria set out in subsection 76(1). The assessment of these requirements determines whether a skilled worker will be able to become economically established in Canada. The criteria are age, education, knowledge of Canada’s official languages, experience, arranged employment and adaptability.


Your application was assessed based on the occupation(s) in which you requested assessment. The table below sets out the points assessed for each of the selection criteria:

You were assigned 10 points for your official language proficiency. This assessment was based upon the language results on file. No points were assigned for your second official language.



No points were assigned for arranged employment.



Five points were assigned for adaptability for a Relative in Canada.



You have not obtained sufficient points to satisfy me that you will be able to become economically established in Canada.


Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the regulations. The visa or any other document may be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(2) specifies that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.



Following an examination of your application, I am not satisfied that you meet the requirements of the Act and the regulations for the reasons explained above. I am therefore refusing your application.
