Apologies if this has been covered elsewhere.

Restoration of status (IMM 5533, p.7)

You may seek restoration within 90 days after your status as a visitor, student or worker has been lost, if you have only failed to comply with one or more of the following conditions:

* You lost status because you remained in Canada longer than the period authorized for your stay (but not longer than 90 days)

My colleague has a recently renewed his work permit for another 2 years in November but didn't realise his 3 year TRV expired in December.

Does the bolded "90 days" refer to how long its been since his TRV expired (in which case he's fine) or the original length of the TRV (in which case he's in bother)?

I hope someone can help.




PS as an aside I've been looking at the phrase "if you have only failed to comply with one or more of the following conditions" for nearly an hour and it still doesn't make any sense and I'm a native English speaker, I pity any non-English speakers. My reading of it is you can seek restoration if you either comply or fail to comply with none, some or all of the conditions listed which covers everybody who's ever existed! :)

Because you are looking at "apples and oranges" the work permit is valid, allowing him to work in Canada. A TRV is an entry document required for persons from Non visa exempt country that they require to enter Canada. The friend only requires a TRV if he intends to exit Canada and re-enter, other than going to the US and St. Pierre et Miquelon. He applies for a new TRV from one of the Canadian offices in the US, if it his intention to leave Canada and return. The instructions are on their web sites. Probably should apply for a 3 year multi entry.
