I applied for CEC in Oct 2014. My app. got returned due to cap being reached.

I applied for extension of work permit before my PGWP expired couple of weeks ago without aor obviously. At that time there was no news of cap being reached.

Since now the CEC app has been returned. Am I still on implied status until I get an answer on my WP app.

And what will happen after I get the reply which will obviously a refusal.
 
Yes - you are on implied status until you receive the results of your work permit extension.

Once the work permit extension is refused, you will be out of status in Canada and will have to stop working immediately.

Once you are out of status - you will have to apply to restore your status in Canada if you want to stay here (you'll have to do this within 90 days of being refused). If you have an approved LMIA, you'll be able to restore your status back to a worker. If you do not have an approved LMIA, then you will have to restore your status and apply to change your status to visitor.

As I understand it the restoration of status has to be done within 90 days

Are those 90 days being counted from the day my PGWP expired which was a couple of weeks ago or will those 90 days be counted from when I get the refusal..

Because whoever processes the restoration application will look at PGWP expiry date because what other date will I have the proof for..

I am very confused and unsure
 
Restoration period starts after rejection. I am also waiting for my BOWP applied on nov 6th so far no response.
 
All can I please get more responses.

A thought just crossed my mind

Its a technical point that I can't figure the answer to

Since I applied for extension of WP and my current WP has expired

Can I apply for TRV right now and if I do that will I lose my implied status

If I apply for TRV will it be the one that says 14 days for study or work permit holder or the one that says 100 days visitor extension

I am really unsure

I don't think you can apply now from inside Canada. It is for valid Study or Work Permit holders ONLY. ( 14 days )

You cannot apply for extension - 100 days - unless u have a TRV and it is expiring.

Should I wait for an answer on the WP application and then apply?

When I try to apply online..It asks the question when is your status in Canada valid till..When I put in the date it says your status has expired apply for restoration

I am confused
 
If your WP extension is refused, you will be out of status as of that day and you may have to leave the country.
Till you hear back, you are on implied status.

Although, I applied for a visitor permit as soon as I got the PR application returned.
When I get the refusal on my BOWP, am I still in implied status because of my visitor permit application?

Yes, until you get the results of your visitor permit application, note you can't work.

Waiting for an answer on WP extension puts you on implied status if you applied before it expired..

When you applied for the Visa, was your WP expired at that time? If yes how did you apply, online or mail?

Because like I said earlier when you try to apply online it asks for date of validity of your status in Canada and when you key in a past date it asks to apply for restoration. I would think if you apply for restoration the implied status will be lost. Applying for anything other than extension of same status will expire implied status.

This is a very confusing and technical situation.

Someone please advise what I should do..

To make things simple my question is

I have already applied for extension of WP which puts me on implied status..

But I want to apply for TRV - will I lose my implied status and how do I apply for TRV as online it requires the restoration

As per my information,

When you apply for work permit extension before your existing work permit expires, You have right to keep working on same conditions stated on your previous work permit until gov makes a decision on your case ( regardless of time taken by them ). Usually you should hear something before 90 days.

In worst scenario if you get rejection on your work permit extension application, You have 90 days restoration time start your counting from date stamp on your rejected application or letter.

In that period you can stay back in Canada and apply for your visitors permit it has to come before 90 days gets over. There is no implied status thing when you apply for status restoration.

You cannot get TRV when you have no status in this country, simply do not apply for TRV until you get your work permit Extension, visitors permit or some kind of proper status in this country.

You can definitely prove me wrong, but this all info is from past experience.
 
I am not sure though but if u apply extension of workpermit via mail u cannot work, only if u apply online u can.
 
We got rejected for CEC as well because the cap has been reached. Our work permit expired and we applied for BOWP by mail (Canada Post) without an AOR. We're still under implied status until we get the rejection of the BOWP. Then we have to change our status into tourist. We have the luck that the employer is applying for a LMIA so that we can restore our work permit. Somebody from customs checked our status and it's all legal.

Visitor permit and TRV are the same thing..what are you saying?

Obviously when you don't have status in the country only then you apply for restoration which will be TRV..so how do you say you can't apply when you have no status
