Hello everyone,

I am a Canadian PR, but my wife is on PGWP (she got that after completing her masters programs), and she is currently employed full time. But now she got admitted to University in some her more preferred course. She already got admission, received the offer letter and all documents. Our concern is is she eligible to apply for Study permit and also continue to work where she is currently employed full time.? Or she has to make one choice.? her employer is OK if she wants to study at the same time (she has flexible timings at work). Her program at university is also full time but that's flexible too. Would it be possible to get new study permit considering she is already using her PGWP to work ?

Even though if she gets Study permit and joins University, and when Work permit expires would she be able to get new work permit (on PR spouse basis) without any hickups.? She doesn't wants to lose both opportunities at hand and we are confident both are manageable at the same time. Your expert advice would be really appreciated. ;D

She has to choose between the PGWP and the Study Permit. If she obtains a new Study Permit this will cancel her PGWP.

Thanks Scylla. We spoke with CIC over phone and they said she can get both, but haven't confirmed anything beyond that. They said apply it and you will know. lol. So you mean she can't work full time and study full time simultaneously? unless she is PR (he PR application is also in processing)..

Correct - however she can certainly study full time and work up to 20 hours per week off campus (just not full time). Treat anything the CIC help desk says with a grain of salt. They don't know the answers to complex questions. These are the same people who have repeatedly told callers you cannot apply using the outland spousal sponsorship process while in Canada.

Thanks, so is it just because its PGWP or even with other work permits too. (if its due to PGWP then can we first apply her work permit - through spousal criteria and then get study permit through university offer letter. makes sense.? Or any other way she can get both things at hand.?

Yes, you can get both study permit and pgwp. Many students are working with pgwp, and attending a full time course.

I have a PR application in process under Family Category (I'm married to a Canadian)

Also, I am working full time with a PGWP but I am looking to get a study permit for a certification I want.

Is it possible to get it? or is it better to wait until there's a Decision Made on PR to start studying again. Thank you

Hi ll0040,

Yes you can get both at the same time. ;)
My spouse just got her new study permit. (but yes you can't work full time and study full time at the same time.) Rather, she can study full time and work max 20hrs/week even though she has valid full time PGWP. My spouse study permit says it all "May accept employement On or Off campus if meeting eligibility criteria as per R186F, V, or W". Well I didn't bother to check what these rules say, you know why, because she got her PR done just two days before she got her study permit. ;D ;D ;D ;D

I would suggest get study permit (no doubt you will get it as long as everything is fair) and start your course full time while working 20hrs/week. Or if you are expecting your PR soon then defer your study offer and continue working full time till you are PR or your deferral date is reached.
