Hello everyone , I have a question . I am now working in alberta in low skilled position with which I can apply for nominee program after gaining 2 years of experience . My working permit expires June 1st 2014 and thats when I will have 2 years of experience in that position . Can my company apply for new LMO in May and I apply for a new working permit also in May and then after june 1st i can still work in implied status , but also after June 1st apply for Nominee program while on Implied status ? I am very confused about all this . I am also getting hitched in April but me and her choose to obtain my PR thru nominee program if its possible . Thanks

I think it's better for you to apply in nomination program before your visa expires. My friend went home because our employer couldn't provide positive LMO. Yes, your employer needs to apply another LMO this May and you have to apply 30 days before your visa expired.

How do i apply for ainp if I dont have the necessary two year experience ? Can I apply for AINP while on implied status ?

I think you have to apply for your extension first and apply for AINP...You have to put in a Cover Letter that your employer already applied your LMO processed in Service Canada.As far as I know, they will not process your application if u dont have a status in Canada...

That is the plan , i would apply for working permit extension with lmo pending and i would be in implied status . So will my application be processed and approved if LMO is negative or they reject my working permit ?

negative lmo/ negative work permit..

if your AINP is approve, you can use it to apply for Work Permit...

I heard that I might be able to be in implied status if I get the file # from ainp and apply for a new working permit ? So may 1st we start the whole LMO process and I send in my working permit application , June 1st my working permit expires , After June 1st I have 2 years of experience , I apply for AINP lets say June 5th while on implied status . Now , in scenario

1. LMO is denied or my working permit is denied in lets say August 1st , and AINP already received my paperwork and I get that case / file # , can I still remain in canada working ?

2. LMO is accepted in August lets say and my working permit is approved with AINP paperwork sent in on June , how long will I have to wait for AINP ?

If you have AINP approval, you can definitely stay here in Canada. If you have negative lmo then negative work permit...no you cant work..You have 90 days to restore your status.

Im not sure how many months for the processing in Alberta. You can check it out!

If you have file number but there's no work permit, you are not in implied status at all...You can go back working if your status has been restored already(Work Permit Approval, Nominated)

Just quick clarification,

You are on implied status if you applied your work permit extension before it expired. Even if the LMO is not approve yet when u apply, you can ask a letter from your employer that your paper in on process and include that with your application. Once it came back positive, call the CIC and tell them your confirmation number.

Apply for Nomination after you extend your work permit. If your work permit was refused because of negative lmo..You have to restore it within 90 days...You can't work after that, if you have positive lmo before they send a refusal letter then you are still on implied status...

Advise, Tell your employer to extend your lmo 3 months before your work permit expired, so you have ample of time to wait for the application...
 
If I apply for nomination while on implied status , can I get my nomination while still on implied status ?
