Hello,

We submitted my husbands application yesterday along with open work permit application. We just realized that we never wrote his name and date of birth on one of the passport photos that had to be attached....will this be a cause of getting the application rejected??

And secondly. If his application is sent back do you only lose implied status if something with the open work permit is sent back or do you also lose it if something from the spouse application is sent back too??

Hi,
Because the OWP application is contingent upon the inland application, they will also send back the OWP application if your inland application gets sent back. So if the application were to get sent back, you are correct that your husband would lose his implied status.

Is he still in status? When is his status up? If you are anticipating even the remote possibility of the application being returned after his status runs out, apply to extend his status online immediately.

For the photos it's hard to say - some people have had their app sent back due to this, other people have received AOR without issue and had new photos requested of them. Be prepared that it may be sent back and may not be, and make the proper preparations to make sure your husband remains in status.
