require help! - I am at 428 and really expecting ITA in march 15th draw. My 30th birthday is on 29th march. If i get ITA on 15th and cannot submit eapr before 29th, will my application be rejected by CIC due to age factor?

Wrong.

Points can go down, but he will not be rejected if points drop below cutoff because of birthday.

Incorrect, the points will go down but there is an exemption from refusal when this happens between the ITA and eAPR stages.

"When a change in age results in the candidate no longer meeting the MEC or having their recalculated CRS points score fall below the lowest points score in that round of invitations, officers should consider applying the public policy to exempt applicants for permanent residence from certain age-based requirements between invitation to apply and application, based on section A25.2. This consideration can result in an exemption from the refusal of an application under section A11.2.

This public policy also grants an exemption to applicants who may be refused for failing to meet FSWC program requirements when their birthday occurs between the ITA and e-APR.È

one more query. If bday and date of draw is same will 5 point reduction happen before the draw time ?

This is taken from CIC website and I am in the same boat execpt for the fact that my birthday is on the 16th of March.

Change for which candidates are not penalized for losing points:

Candidate’s birthday occurs after an ITA was issued (see the Exemption to section A11.2: candidates whose birthday occurs after they receive an ITA section).
 
thanks for the reply. What i am concerned about is when draw and bday happen the same day. Now i am at 428 and if draw cut off is 428 that day will i still get an ita before i loose 5 pts?

I am worried about the same thing. My bday is on Mar 29 and my CRS is 429. What if the draw is on Mar 29?

Ahmed Hussen messed things up for you. You will drop to 423. It is such a horrible bday gift to lose points. I lost 5 points last month when I turned 30.

Yes probably there will be a draw.
 
Coming back to this subject..

The write up from CIC website basically says that officers SHOULD consider to apply public policy, which CAN result in exemption from refusal on ground of age. So this means that the regulation provides no guarantee to the applicant that an exemption is granted. It is a recommendation whose implementation is left at the discretion of the officer who will consider whether or not to apply the exemption. It may be that - in practice, it is common that exemption is granted but there seems to be a residual risk.

Please advise based on your experience, as my birthday is occurring soon while I did not have submitted my eAPR yet.
