Hi, im an indian citizen. I came to Canada in 2015 as an visitor with my husband. Than applied for study permit which got denied due to errors by the representative which i appealed in court but no luck. Than I applied for H & C which today got refused. please can you advise what will be the options to live in Canada

I'm assuming you are now out of status in Canada.

If so, the only real option at this point is to leave Canada and then apply from outside of Canada to be able to live here again. Based on your immigration history in Canada, any sort of temporary visa (including a study permit or work permit) has effectively zero chances of being approved. So you will want to look into applying to immigrate once you have left Canada. I would recommend that you start by looking into the Express Entry program. Details are in the link below:

can i go for court appeal or refugee

There is no right to appeal for refused H&C applications. In some cases there is an option to ask the Federal Court of Canada to review the case. If you want to try this, you should hire a very good immigration lawyer.

In terms of applying for refugee status, there is nothing in what you've written that would indicate you qualify for refugee status.

Agreed. An attempt at a refugee claim at this point would likely result in a quick refusal and be seen as a means to extend your stay in Canada, based on your immigration history.
