The question has no relevance to Canadian immigration but if someone can highlight to me what needs to be done I would be highly obliged.
My brother is currently in London on a study cum work visa. He completed his MBA in Finance and since last 2 years after his course is working there. Recently he got a good opening as a Compliance Associate but his company is not ready to help him on his visa status.
His visa expires in March 2012.Can he continue to live and work in UK on some TIER VISA.
If yes what are the options he has.
Those in Uk can highlight the procedures . I have spend a lot of money on him and wish to see him settled there.
I have no idea on the immigration laws in U.K. He just told me the last time he called me that he needs to see a solicitor.
Plz can someone provide me some clues.

HI there,

firstly, I dont understand what you mean by ""study cum work visa" i think these are 2 seperate categories either study visa or work visa.

if the company is not wiling to sponsor your brother then he can't work here at all because the teir 1 visa is no longer available to any one from within or outside the UK, tier 2 is for those who get sponsorship from any company and the sponsoring procedure is too tough for conpanies to even bother about it when they have people available who are already authorised to live and work in UK.

if your brother have spent 10 years in UK then he stands a chance otherwise the only option i see for him is to get married to a british citizen but again this can't be done on student visa, he will need to go back to his home country for this too, later he can apply as a spouse which also takes atmost 3 years time from UKBA to finalize, because no matter how "genuine" the case is they still trouble the applicants for lame reasons.

another thing which people do here is they come as (tier 5) religeous workers i dont know exactly what it is but i think atleast its not for your brother who is MBA in finance...

your brother is right he should consult a solicitor but he should be careful because after all rules are there for everyone a solicitor cant go out of the way to help him and if he claims any such thing then your brother should be very careful before handling his case and spending money.

Yes I think he can convert his visa in PSW (Tier 1 Post study work visa)
Requirments bachlor OR master degree from uk.

I will speak with him. He went on a post study / work visa in Sept 2008 and completed the course by Jan 2010. In between he worked in various places on survival jobs but was restricted to 20 hrs per week. He did a 1yr course in Mba ( Finance ) frm Lincoln University and currently works for a company called Momenta.
The choice of marrying a British national does not fit his bill as he is already a married person with 2 kids and he will not go out of his way as he is a hen pecked husband .
I hope and pray he comes out with some breakthrough.

UK immigration rules suck at the moment why dont he try for canadian immigration? btw whats his nationality?
 
He is a Indian national. He cannot try the Canadian immig since his NOC code is not on the list.
 
Ask him to take the Denmark green card route or if he doesn't want to go out of London there are 2 options in current scenario

1 look for a tier 2 sponsor, who can sponsor your brother for a job .

2) look for a EU girl to get married .
