Hello folks

Need a bit of advice here. I am currently about 5 months into the family sponsorship process through London my Wife being my aproved sponsor. At the start of the process being from Northern Ireland i originaly applied for a NI criminal police check, soon after I realised it was the wrong one and I actually needed the apro police check which i then ordered.

Both documents arrived and since the NI one was cheap and not relevent it got ignored and i opened the apro check which had "No trace" happy days it got sent in with the application.

A couple of days ago while clearing out I found and opened the NI Police document and had a little read and there is a conviction on it for a motoring offence in 1998 "driving without due care and attention" ( at the time i remember getting the penalty points and fine but just figured it was a fixed penalty and didnt realise it was an actual conviction ) so bugger me i checked no to criminal convictions on the application on my understanding that it was a fixed penalty and the NO trace on the apro!

so my question is should i contact London with a groveling email explaining the above situation or since it was no trace on my police check leave it?

any advice is very much appretiated

Yeah I suggest you contact them to clear up that. Since it appear to you as a problem . You have nothing to loose clearing that up .

a driving offence isn't the same as a criminal conviction, in most situations. a criminal conviction would be anything that is considered a misdemeanor or a felony and would make you inadmissible to Canada. was it a DUI or did you run someone over? from the sounds of it you didn't even remember getting the ticket that was issued, so I'm guessing it's probably just for a violation, like speeding. you'd remember being punished for something more serious.

from what I understand of the NI police check, it brings backs criminal convictions, but also any "cautions, reprimands and final warnings and any other non-conviction information that is considered relevant". so not everything on it would be considered a criminal conviction by CIC. given this, it's really up to you what you want to do about it. if it would ease your mind, send your VO an email and explain you weren't sure if a driving ticket was considered criminal & are only now having second thoughts about how you answered the question. my husband has gotten speeding tickets and accident tickets in the past, but we still answered no to the criminal questions because those are different than a criminal offence. I have no worries about it, but you should do what you think is best for your application :) good luck x

Like the majority on the planet who drive i have had my share of penalty points of course i never thought any more of them and in my mind i had this incident lumped in with them until i happened upon the report. It was for an accident myself and another driver caused 50/50 but a third party was injured not seriously thankfuly, a guy on a bike recived a broken arm. At the time it really wasnt a big drama coupled with the fact it took almost 5 years for the insurance companies to decide who took the blame etc, by the time i was informed of the outcome the penalty points had run their course and i no longer had to declare them. So as far as I was concerned that was that.

Going to inform them anyway, best to be on the safe side and hope i get a sympathetic ear
