Hi,

I am in the process of applying a PRTD, and have filled the first section of 14 questions,which are my personal details and my questions are regarding the second section i.e. residency obligation sections. I got my PR last year with a validity of 1 year ending on 03/13/2015, and I landed in Toronto on 02/06/2015 to complete the landing formalities and returned to my home country due to personal reasons on 02/20/2015.

I still have 4years 3 months left to satisfy my residency obligation, my questions here is should I just enter the information as stated below with appropriate proof's or provide H&C reasons as well? My assumption is H&C reasons are needed only when I am sure that I don't meet the residency obligation and/or have lost my PR status and want the visa officer to consider my case on H&C grounds. Since I have been a permanent resident for less than five (5) years, I can satisfy the residency obligation criteria of 730 days from the remaining 4 years left and don't think I need to take support of H&C. Please advise.


Here are the details entered in the application form:-

#15, Time spent: I have entered the dates as per my passport stamping which is a total of 15 days along with the residing address. I am sending my passport along, which serves as the proof for the duration I stayed.
#16, Accompanying a Canadian citizen or permanent resident outside Canada: My option is 'NO'
#17, Employment outside Canada: My option in 'NO'
#18, Humanitarian and compassionate grounds: Not entered anything as yet.

I am bit worried as the checklist IMM5627E classifies only the supporting documents for the above three questions as a proof to meet residency obligation. If I don't furnish the H&C grounds, I am assuming I have nothing in my case for the visa officer to consider. Will COPR be the only document that I sent with my application in my case? I fear that the visa officer may reject my application for want of proof for the questions above. From what I have filled, will it satisfy the requirements to have my application approved? Is satisfying one of the above questions a mandate to have the application approved or simply based on the duration I have the residency obligation will be met?

Also I would like to know if I should share the original documents as supporting documents or will a photocopy suffice? What if they retain the original documents like the COPR in case they declined my application?

Wanted to check if you got the PRTD as required? If yes, please help with number of days it took to apply. I am planning to apply for PRTD on Jan 2016, and I landed in Canada in Nov. I have to travel back due to personal reasons (for two weeks) before my PR Card arrives
 
I am going to apply PRTD as well, I need to visit family during PR Card processing, will see how it goes.... ;D

Looking at the enforcement manual, OP 10:

In determining whether a permanent resident meets the residency test of physical presence for at least 730 days in a five-year period, A28(2)(b)(i) and (ii) state that:
28.(2)(b) it is sufficient for a permanent resident to demonstrate at examination
(i) if they have been a permanent resident for less than five years, that they will be able to meet the residency obligation in respect of the five-year period immediately after they became a permanent resident;
(ii) if they have been a permanent resident for five years or more, that they have met the residency obligation in respect of the five-year period immediately before the examination [of their residency status by a visa officer].

Legally, what you need to prove is that you can meet the obligation, not that you will. Your CoPR should be sufficient information to demonstrate this.

I am in a similar situation as yours , I landed on 9th Nov and still waiting for the PR card. Though I need to travel back to India for some urgent personal work for a week. Hence I am thinking of applying for PRTD incase I come back, can you please tell what is the scenario in your case and are you able to apply for PRTD , if yes then how much time did it take for your application to complete ?

Please reply, I am in a confusing state i.e. whether to go for PRTD or not.

I applied PRTD on Jan 4th at Chennai, India. On Jan 08 i got e-mail that the processed passport has been dispatched. Today I received the passport with PRTD issued. great relief as i dont have to change the travel plan..

Congratulation! Only took 1 week for your PRTD, it my turn now, I am applying on Jan 15th. Hope will get speed process same as yours.
 
Hello Everyone ,

Just an update on the Processing time of PRTD from New Delhi(VFS), India.

I applied the PRTD on 15th Jan 2016 and received the stamped PRTD visa on 21st Jan 2016. So total of 5 working days

Mine is only 5 working days as well, applied from Thailand.
