Additional family Information IMM 5406

Hi,
My husband is permanent resident for 6 months now and we thinking about to sponsor his brother (10 years old). But we never declared him on the Additional family Information IMM 5406.
Does anyone has experiences about sponsor a family member even it was not declared on that form?

Your husband cannot sponsor his brother unless their parents have passed away. His brother would be considered to be an orphan brother in which he is qualified to be sponsored by your husband.

To sponsor his brother not declared on his additional family information form, may pose a problem. I can't say for sure. I cannot provide you a definitive answer on that.

I know for sure that any immediate family (sons / daughters / spouse) not declared are pretty much banned from being sponsored.

Not so sure about those not declared on additional family. Hopefully someone else can give you a better answer.

One concern I have is that your husband may have misrepresented himself at landing as PR by not declaring all his family members. If he goes ahead with the sponsorship of his orphan brother, he can be at risk of losing PR due to charge of misrepresentation.
