If you are referring to points for a relative under adaptability, then my understanding is that this is for blood relatives of principal applicant only (someone please correct me if I am wrong?).

Have you submitted an application yet? Please note that FSW applications without a job offer are NOT currently being accepted by CIC. Applications are expected to open again on a limited basis around January time.

If you have a job offer of course you can still apply but will have to meet the 67 points.

Yes, you can get 5 points for your brother-in-law as long as you are still married with your wife (not divorced)
 
yes, you can if you can show

1. birth certificate of your wife and brother in law have common parents name.
2. your Brother in law, mentioned your wife's name as his family while applying for PR
3. your BIL can provide his Canadian citizenship/PR proof, Income tax returns, utility bills, credit card/bank statements
4. most importantly, you don't get divorced before finalization ( sorry to say this, but have seen such cases on this forum !!)
