Good day everyone. I have a situation. I am currently married here in the Philippines but I am no longer with the wife for 9 years, she's been in the middle east since she left me and my son and my annulment is currently being heard in court with no final decision yet. But I have a girlfriend of 5 years who is in Canada right now. I have not seen or have heard about the wife for 3 years before i met my girlfriend. I have not felt so important in my life since I met her and she loves my son even though it's not her biological son, she wants to be a mother to him.

She's a PR holder and probably a Canadian citizen in a year from now. However, we have not cohabitated for a year since she has only came home here in the Philippines 3 times. 2 weeks to 1 month stay each time she comes home. That's the only time we live together. She wants to take me and my son to Canada and start a family. Constant communication through the net is our only way of keeping in touch with each other. Every day for the past 5 years. Our relationship is just something i could not just throw away since our parents are already very close to each other. We really want to spend our lives together.

The question is, what are our options? Can she sponsor me and my child the soonest while the annulment is still ongoing? What should we do?

Try google this is a common issue with pinoys and you will find an answer.

You could try for conjugal. However, less than 3 months together in person over 5 years is a fairly big red flag. Genuine couples make the effort to see each other as much as possible. Not even visiting once a year isn't much effort.

You will also need full custody from the courts or the mother's permission for your child to immigrate.

Thank you for your enlightenment. Asking for the mother's permission is out because I haven't seen her for the past 9 years and not sure of her whereabouts.

The 3 reason she (girlfriend) couldn't come home is because she waited for her PR and she was supposed to come home this year but this Covid-19 pandemic made it very risky for travel. I will try to search on the possibilities of conjugal as it was the status I've been searching for. Thank you

She could have travelled while waiting for PR, applying for PR, after PR. The pandemic has only been happening for a few months, so not an issue for the past 5 years.

Yup. Should have been. Her father dies 2 years ago and there was a lot of experience incurred She was supposed to come home this April. That could have been the fourth. Hopefully when this pandemic is over, she could come home.
