Hi all,

Wanted to explore if someone has any information about this matter.

I am a Canadian Citizen who sponsored my wife back in 2005. She landed in Canada June 2005, and we were living there until July 2006 (one year).

I got a job abroad and moved out in July 2006, and of course she accompanied me.

Now we are both wanting to go back to Canada and settle again. Her PR card expired of course. Now, is there any law (or similar) that would allow us to renew her PR based on the fact that she was accompanying her Canadian citizen husband who works aboard, or we just have to start the whole sponsoring process from scratch.

Hi

A day outside Canada with a Canadian spouse counts as a day of physical presence in Canada for the PR residency obligation.

If your wife is visa-exempt, she can travel to Canada on the strength of just her passport. When you guys go through immigration, she can show her expired card and explain that she has been living outside of Canada with her Canadian spouse and therefore meets the residency requirement. Once in Canada. she can submit an app to renew her card. She'll need to include proof that she was with you while outside Canada.

If your wife isn't visa-exempt, she needs to a apply for a PR Travel Document at the embassy in your current country and include the proof that she has been with you and therefore still meets the residency requirement.
