My application for my spousal PR was sponsored and submitted in February 2012, but in 2015 it was rejected then my spouse went for appeal and application was approved and I was granted PR and landed in May 2016, I was divorced in 2018, and now I am married and want to sponsor my new spouse to come to Canada as PR. According to law I can not sponsor my new spouse until I am 5 years of holding PR after landing. But since I was sponsored and accepted in February 2012 as applicant and 5 years Bar rule came into effect on March 2, 2012 I find myself eligible to sponsor my new spouse regardless of when I became PR or landed in Canada!

Question: My application was appealed in 2015 for the very same FILE number which was generated in February 2012. Does appeal make me ineligible to sponsor?

Correct - you should be OK.

You say ". According to law I can not sponsor my new spouse until I am 5 years of holding PR after landing". Then you say "I was granted PR and landed in May 2016".....I think you answered your own question

It doesn't matter when you submitted your application to be sponsored by your ex. The 5 year bar started the day you landed as a PR in May 2016.
