Hi There,

I'm just about ready to send off the application to sponsor my wife as a permanent resident. I just have 3 questions about the application and was hoping you guys could help. I should add, we are sponsoring from within Canada.

1. Her Criminal Record Check from her home country is almost 3 months old in about 4 days. Her criminal record check from our city in Canada is less than a month old. We should be ready to send in the application in about 2 days. Will her criminal record check from home country still be accepted as long as we mail it in before the 90 day mark ?

2. I'm also waiting for my Option C printout for CRA, it should arrive in the mail either tomorrow or the next day. How important is this form ? I have letter from employer, pay stubs, T4's, etc. I'm just worried about the criminal record check expiring while we wait for the Option C printout.

3. When sponsoring my wife do we need letters from friends, and family to say that we are a legitimate couple ? We're a little unsure as to whether that is only for common-law, or not ?

Option C is important as they do request you to include it in ur application. If you are legally married to ur wife, you really don't need the support letters from ur friends and family. But if u don't have a strong application ,the support letters will help you. My opinion ,include the support letters.
 
1. It's possible that it will be expired before CIC receives (and acknowledges that have received) your application.

You did not need a PCC from Canada, unless CIC specifically asks for one.

If it does expire will they reject the application ?

they will do 1 of 2 things:
send a letter requesting an updated record or send back the entire application. there's really no way to know for sure. my suggestion is to get a back up record and have it ready in case there is an issue. what others have done is attach a note to the record stating they have applied for a new one and will forward it as soon as it's received.
 
So if we mail it off before it expires, will that be ok ? Or do they go by the date they receive it and acknowledge it ?

i believe it is based on the date they receive the package, though can't say for sure since i don't work for cic. again, i'd recommend mailing it before it expires, and attaching a note to let them know you are forwarding a new one. either way it's best to apply for a new one. whether you send it with the old one or wait for the new one is up to you. currently the fbi wait time is 26 days, not including mail delivery.
 
In order to get another one we will have to either A) Travel to Argentina which will be very costly. or B) Travel to the Argentine consulate in Ottawa to get a new criminal record check.

I'm thinking we'll submit the application with the old criminal record check, and include a letter stating that "We had to wait quite a while for the Option C, and if requested to get another up to date criminal record check we'll travel to Ottawa to get a new criminal record check from the Argentine Consulate."

How does that sound ?

personally, if it's that much of ordeal, i would just not say anything and take chances. is there no way to apply by mail?
