Hi All,

My company was about to apply for LMIA. My PGWP is about to expire in July 2017. And my immigration consultant told me if my company pays another $1000 along with LMIA fees, then they would be able to acquire another 2 year work permit for me. Is it true?

No idea what the consultant is talking about. If your employer wants to retain you after your PGWP expires, they need to actually apply for and receive and a positive LMIA.

Yeah I dont know why they said that. Even I am confused. They were like if my employer wants to retain me after my PGWP expires, they need to pay extra $1000 for another work permit, even if this LMIA would only be for PR purposes. So in case my LMIA doesn't comes out positive, I'd still receive another work permit.

Are they cheating?

Are they talking about a dual-intent LMIA?

Yes I guess. But is it possible? I mean working on a 3yr PGWP and then gaining another work permit by applying for it along with LMIA?

I imagine that is fine.

oh that's cool. But i guess my company has the option to go with it or just apply for LMIA without dual intent.

Also, as per my consultant, we need to post the job position on a paid website. How much could be the charges for a month?
and is it ok if I pay for it rather than my company?

Sorry I know I should ask all these ques. to my consultant but dont want to wait until Monday. :D :D

Your employer needs to meet the minimum advertising requirements outlined here:

https://www.canada.ca/en/employment-social-development/services/foreign-workers/hire/median-wage/high/recruitment.html

Your employer will need to advertise the job in a minimum of three places. Your employer is supposed to pay these advertising costs.

FYI - An approved LMIA is required to extend your work permit.

Thanks scylla. Though I didn't understand one thing. The link says
The advertisement must be posted for a minimum of 4 consecutive weeks starting from the first day the ad appears and is accessible to the general public;
The advertisement must be posted during the 3 months prior to the employer applying for an LMIA.

Does this means the employer can't apply for LMIA before 3 months whatsoever?

No - the job doesn't have to be advertised for three months - just for four weeks. What that rule means is that the four weeks the job is posted must happen within the three month period before the LMIA application is submitted. In other words, you can't advertise the job for four weeks and then apply for the LMIA five months later.
