I got married to wife in Pakistan while my PR case (Under international graduate category) was in progress. she came in Canada in 2016 on open work permit under skilled spousal category. we got PR in Aug 2017. Unfortunately, the things did not work out and we applied for divorce in Pakistan in Jan 2018 and got divorce back in Pakistan in May 2018. Now, do I have to wait for a period of time before I can get remarried in Pakistan and sponsor my new wife or I can straightaway
(1) do Nikah with my 2nd wife?
(2) sponsor my 2nd wife?
 
You can sponsor right away, but your application will face lots of scrutiny due to the quick end to your marriage, and that you're doing another sponsorship from the same country.
 
if when you got your PR in 2017.........your ex-spouse was also included in your PR application......that won't be considered sponsorship......you and your ex-spouse landed as PR in 2017......and neither the 3 or 5 rule would apply........you should be able to sponsor if you re-marry......

3/5 rule
  • were sponsored by a spouse or partner and you became a permanent resident less than five years ago
  • sponsored a previous spouse or partner and three years have not passed since this person became a permanent resident

Hi Thank you for the confirmation. I did call the CIC and they also confirmed the same as I applied through PNP, therefore, the 3 year rule does not apply.
