Hi all,

I am hoping someone can help me please,

I am a UK National hoping to move to Canada (any province) and currently work for a large international's business.

I am interviewing with the Canada office currently and will likely get a job offer from them.

However, they have said they will not 'sponsor' me, but i am not entirely sure what that means.

The job will be in a managerial position within the sales team.

I was hoping someone could answer a few questions for me as finding out the info online is quite hard.

  • If they won't sponsor me, does that rule out the 2 week express entry visa for skilled labourers?
  • If the above is correct, does that mean I have to apply for the work permit through the express entry points system for me and my wife?
If that is the case, I will get started with that application and see how i get on,

Any help would be appreciated,

Thanks,

Dave

You are confusing terms and programs. Express Entry is an immigration program that gives you permanent residency - it does not grant a work permit. If you want to obtain PR through Express Entry, then you need to create an Express Entry profile and wait to be selected. Before you can even create a profile, you will need to have your education officially assessed and also complete a language test. Express Entry is a points-based program and those with the most points are selected out of the pool. Right now you need to have around 470 points to be chosen. So start by figuring out if you have enough points to be selected. If you are chosen, it will take around six months for the application to be processed and approved (not 2 weeks). Note that you will not be able to claim 50 points for having a job offer in Canada - you would only be able to claim these points if your employer in Canada gets an approved LMIA.

If you want to obtain a work permit instead, your employer would need to go through the ICT (intra company transfer) process or obtain an approved LMIA so that you can qualify for a work permit. None of us call tell you what your company means by not being willing to sponsor you - you are going to have to ask them what this means. I'm not sure your job is senior enough to qualify for an ICT work permit. If this isn't an option, then the alternative is for your employer to obtain an approved LMIA. This is a long and expensive process for the employer that generally takes 4-6 months and requires your employer to advertise your job and prove no Canadian could be hired for the role.

If you are 30 or under, one last option would be to try to secure an open work permit through the IEC / working holiday visa program. Visas are awarded through a lottery and the program is always oversubscribed (meaning far more applicants than spots available). But you can certainly try if you are the right age. If you are selected, it takes around 2 months for the application to be processed.
