    Refugee/Asylum Claimants 2023 Timeline

Are you located in Eastern provinces?. The delay could be due to that. Also, complexity of your case and delay in background check and FESS.

    Need help with regaining status

I am not sure why you wait until last minute to face this situation. Since you would face persecution in your country, why you did not file refugee claim before expiry of your study permit. PRRA is not at all equivalent to refugee process and chances of successful PRRA are quite low. Now you...

H&C Humanitarian Ground with/or Without Failed refugee claim

This EMPP is for refugees outside Canada. I do not know why IRCC can not come up with solutions for people who are inside Canada struggling.

H&C Humanitarian Ground with/or Without Failed refugee claim

IRCC should increase quota for H and C and refugee immediately. The current quota is unrealistic and does not make sense at all. 70K applications in the pool competing for 10k target is irrational. How to absorb people from war torn countries who are living in Canada on temporary permits...

H&C Humanitarian Ground with/or Without Failed refugee claim

It is frustating what used to be the processing time for whole H and C has just became processing time for AIP.

    Again... Front-End Security Screening

Where did you apply for refugee?. If eastern region, it would be expected to wait that long for hearing. If western region, it would be highly unusual to wait 2 years for hearing.

    Out of status protected person

If you are under removal order, you are not eligible to make refugee claim. However, you may be able to file H and C application. I highly suggest you to consult lawyer as soon as possible.

H&C Humanitarian Ground with/or Without Failed refugee claim

Parent and grandparents are not entitled to H and C. They can stay in Canada on 10 year supervisa and apply for PGP. H and C is program for those who will face extreme hardship if removed from Canada, families who are established here, have children and not eligible for other PR pathways.

H&C Humanitarian Ground with/or Without Failed refugee claim

BIOC is crucial factor in H and C application that the decision maker must consider. All courts in Canada have emphasized that BIOC must be primary consideration in H and C. If BIOC is combined with other factors such as hardship in country of origin and establishment, this will make strong H...

H&C Humanitarian Ground with/or Without Failed refugee claim

The majority of this backlog is parent/grandparent and sibling cases. I have hard time understanding why reforms are not implemented in H and C program. If the current trend continue, applicants will just receive AIP if they have compelling factors to stay such as BIOC and second stage will be...

Estimate for Refugee Hearing Date for Refugee Claim Filed 2025

RPD has country specific reports that are used to help determine outcome of refugee claims. What I mean by unstable is the countries that experience armed conflicts, civil war, political division where is more than one government, and fragile countries in which militias and other non-state...

I think you have AIP since Niagara office is the one processing second stage.

Estimate for Refugee Hearing Date for Refugee Claim Filed 2025

Country conditions are more crucial than specific threats. If someone has threats in stable country, members in the hearing will argue that the claimant has internal flight alternative and can move to safer regions within the country. Applicants from war torn and unstable countries have high...

    Hearing details

Hi, is background check on IRCC portal in progress or complete. I think you will likely have hearing around 15-18 months after referral.

H&C Humanitarian Ground with/or Without Failed refugee claim

As far as I know in the last 5 years, I dont remember processing time for any immigration program to be longer than 36 months, except in Quebec.

H&C Humanitarian Ground with/or Without Failed refugee claim

I agree. It seems the delay is on purpose because why on earth AIP which is just a decision on eligibility takes 2 years now. Stage 1 decisions were just taking few months back in 2021.

Estimate for Refugee Hearing Date for Refugee Claim Filed 2025

Do you mean not referring cases to IRB if applicant resides in Canada for long time. I think this is mentioned in proposed Bill C-2. Not sure if this constitutional or not. IRB states on their website that delay in making claim is not decisive factor in itself. One thing I noticed in bill C2 is...

H&C Humanitarian Ground with/or Without Failed refugee claim

I never imagined processing time for any immigration program to be that long. With current backlog in H and C applications 70k, unfortunately unless reforms are implemented to speed up first stage decisions, processing time may get worse. One thing I hope IRCC will do is to remove all cases not...
