Classic law school case, not classical....please HELP!

I think you are right on this one from what I sent in my last post. It seems the IAD has discretion over it but it is not longer a right to enter Canada. So yes it is going to be much more difficult. I was wrong on this when I said it the applicant's right.

Classic law school case, not classical....please HELP!

With the hearings being done virtually, this may become unnecessary. The result again is that the applicant is better off returning to Canada while the status is still valid with the expired PR card and do what we discussed above.

Classic law school case, not classical....please HELP!

There is something I am not quite sure as I had read it somewhere a while back: once the PRTD is rejected and the notice of appeal is sent to IAD, I am not sure if it is discretionary for IAD to issue a travel document for the applicant to return to Canada or they MUST issue this. The whole...

Classic law school case, not classical....please HELP!

@cango2017 if you haven't already done so, you may want to get yourself acquainted with the IAD (Immigration Appeal Division) website and form which is going to become handy soon: https://irb.gc.ca/en/making-immigration-appeal/Pages/immapp-bc1.aspx I believe the important point here is that...

Classic law school case, not classical....please HELP!

I must say there are some points above that I disagree with "It also means that the applicant cannot return to Canada (or at least much less easily) and so less likely to result in long appeals processes while the applicant potentially accrues more of a basis for H&C consideration. (I'd be...

Classic law school case, not classical....please HELP!

@dpenabill and other experienced members: I have been asking myself about the experience of @cango2017 above about why an official may ask them to get a PRTD and insist on it on a citizenship application. For one thing, getting a PRTD would involve the embassy in their home country and...

Process for citizenship while no longer living in Canada

I have some personal observation to add to the above. I have been reading tens of pages here (not hundreds) about other people's experiences. It seems to me (and again it is a personal observation so I might very well be wrong) that people from certain countries like in the Middle East and East...

RQ versus Physical Presence Questionnaires, including CIT 0205

I would have to ask him about permission to see if he is ok with disclosing his info here. The other issue is that I dont want this to be like an advertisement of a specific lawyer. Lastly, this guy helped me a lot as the circumstances were right for both of us at the right time: he was not...

RQ versus Physical Presence Questionnaires, including CIT 0205

I am not sure how common are RQs these days. However, I can speak of the 2 people with RQ 0171 whose paths crossed with me while my RQ was being processed (or I should say my application was not being processed pending the review of RQ). One of these people was in the same shoes as me: he was...

RQ versus Physical Presence Questionnaires, including CIT 0205

Sure, so I am going to hide some details and also move my actual dates a bit to keep my privacy, but the essence of the case will be the same: I applied around Nov 2017 with around 30 days of buffer days with many, many, many travels abroad, but my calculation was EXACT and bulletproof...

RQ versus Physical Presence Questionnaires, including CIT 0205

I just noticed: your RQ is very recent. Be patient! you are very well under the normal processing times for someone with a lite RQ. It shouldnt be too long for you to hear from them if all the docs are in good order.

RQ versus Physical Presence Questionnaires, including CIT 0205

@dpenabill I forgot to mention something: although my CIT 0520 docs were satisfying enough (the ATIP notes from someone in citizenship showed they were finally reviewed at the grant of citizenship) yet as IRCC knew I am out of Canada, the chose to move me from CIT 0520 to CIT 0171 (the so called...

RQ versus Physical Presence Questionnaires, including CIT 0205

@dpenabill I became citizen after a bloody loooooong process through CIT 0520 and then the full RQ 0171 versions which took very very long. I just want to thank you for the maybe not up to the point but (considering your limited knowledge of the cases) giving very full and honest advices. My...
