one-year pilot OWP for spouses and common-law partners

From what I can understand, I cannot be removed, since I do qualify under public policy. From what I also do understand, my PR application won't be affected in a negative way, because I had legal status when it was submitted. If all this is true, it's not as much of a big deal that I first...

one-year pilot OWP for spouses and common-law partners

But they didn't know about this new pilot program back in may. I won't blame them for that. However it is not acceptable to let me run out of status and claiming that i have implied status. "Under the current Regulations, applicants in this spouse or common-law partner in Canada class must...

one-year pilot OWP for spouses and common-law partners

Thank you all. I have been most worried about that I can get deported because "out of status". However, after reading this, over and over again, (english is not my mother tongue), I take it as that is not the case, I cannot be removed or deported since i qualify under "lack of status" and the...

one-year pilot OWP for spouses and common-law partners

"However, applicants who do not have temporary resident status and who cannot be granted positive consideration under the public policy can be removed at any time." Wouldn't my lawyer be able to claim that I qualify under the public policy and therefore they have done nothing wrong? "What is...

one-year pilot OWP for spouses and common-law partners

Thanks for this link, but the main difference is that this person had been out of status for what? 7-8 years when application was made? And there was already a warrant out for him to my understanding, several years before application was even made.

But couldn't she claim that is a recent change?

one-year pilot OWP for spouses and common-law partners

I know this. They will likely claim that recent changed and recent changes only makes deportation possible. They are likely to claim that no status used to be as good.

one-year pilot OWP for spouses and common-law partners

Thank you. Appriciate it. However, in email conversation today, they have already admitted that I am not guaranteed not to be removed. It sounds like they will try to blame this on recent changes, and that back in May 2014 this was not case - therefore they have done nothing wrong. I'm not sure...

one-year pilot OWP for spouses and common-law partners

I know, but I have a strong feelin they will claim that back in May, no status was as good as implied status. They will claim the only reason it's not as good anymore, is because of pilot program. I have a strong feeling this will be their defense. How can I prove to them this is not the case?

one-year pilot OWP for spouses and common-law partners

Yes, I understand. But how can they claim that they did what was best at the time, and that rules have changed, therefore its not the best anymore? Letting me run out of status was never the best option. I think they might try to claim that before, when application was made, i couldn't get...

one-year pilot OWP for spouses and common-law partners

Phew. But this is the part I do not understand: "because even by allowing your status to expire (which is what they did), you wouldn't have been eligible for the normal OWP that Inland applicants can get AFTER they reach AIP". Edit: Is wouldn't a typo?

one-year pilot OWP for spouses and common-law partners

Im sorry, I'm not completely following. Are you saying that I won't be able to apply for a work permit even after intial assessment is done, in let's say, October?

one-year pilot OWP for spouses and common-law partners

But they will claim that rules have changed. How? I wonder if they will try to refer that it used to say that people without status could still apply, and now it says that you need to have a status. They might claim that I used to be fine since people without status could apply, and that there...

one-year pilot OWP for spouses and common-law partners

When I talk to them tomorrow they will claim that what they did was best for me at the time, and that things are changed now. I have a feeling they might claim that I used to have implied status, but do not anymore. Maybe something like that, idk. How can I prove to them that they are wrong?

one-year pilot OWP for spouses and common-law partners

I recieved this from a representative as part of an email: "As I explained there were some changes on the government side that took effect early this year. There was no way we could have known about these changes as they were not announced until after the submission of your application. The...

I don't care too much about this program anymore, I just wish I could have my status restored and not have to worry.

one-year pilot OWP for spouses and common-law partners

Ok, but I assume he is likely to get restoration. There is absolutely no way for me to get around this and get restoration? No point in even trying?

one-year pilot OWP for spouses and common-law partners

I think I have read your posts before. Correct me if I'm wrong, but you have applied for OWP even though you like me, are out of status? If so, could you please update me on this process? Isn't the risk for you to get removed higher simply because its more likely for CIC to become aware and...

one-year pilot OWP for spouses and common-law partners

Do I understand this correct. CBSA has to find out that I am out of status. It is pretty unlikely that they would find out, CIC is not likely to inform them? Even if they find out, they have to decide to start the process to deport me, which is unlikely. If they decide to start this process and...

Yes, true. I guess I just enjoy hearing that I probably will be fine. My lawyer must have done it like this because in their experience, you're always fine. Still extremely unprofessional.
