H&C Humanitarian Ground with/or Without Failed refugee claim

1500 pages to review taking much longer to evaluate is actually quite justifiable and why I would not recommend that people submit such a long application.

    Québec PR Timelines

To have a chance of writ of mandamus your processing time has to be significantly longer (years not months) than not only posted processing time but actual processing times which are often not the same. Processing times in general are getting longer every month so the average processing time...

Travel outside Canada whilst on Implied status (SOWP)

No issue. You are a visitor and will attempt to reenter as a visitor again.

H&C Humanitarian Ground with/or Without Failed refugee claim

Sure you can renew your passports early if your home country allows this. This doesn’t solve you issue that after April 2026 unless you have AIP you will no longer have status and may struggle to extend your status as visitors.

H&C Humanitarian Ground with/or Without Failed refugee claim

Canada can’t just increase quotas because that will lead to increased PR numbers. If you come from a warn torn country you will likely qualify for asylum so will not be asked to leave. The H&C program needs to have much stricter requirements in terms of who can apply and we need to stop adding...

H&C Humanitarian Ground with/or Without Failed refugee claim

If passed the implementation would be backdated to June 2025 so would automatically be denied. Having a record of having tried to claim asylum could also have significant longterm consequences in Canada and abroad.

    Virtual Landing

There is a long backlog of people waiting for landing in some programs and IRCC is slowly landing people over the year. Although you may have your final decision it could still be months until people get P1.

UK to Canada Gift – Can I Declare a Lower Value?

Sure you can but it is illegal. Likely pretty obvious that not worth $60. You may or may not get caught.

H&C Humanitarian Ground with/or Without Failed refugee claim

That is going to become pretty standard processing time and may actually get longer. If I am remembering correctly this may be the case where the application was something like 1000 pages which may have lead to increased processing times.

H&C Humanitarian Ground with/or Without Failed refugee claim

How old is she? Can she care for herself even with some help? H&C is not a substitute for PGP and there are likely to be a lot of parents who will be denied H&C. In this case she had the ability to remain in Canada under her supervisa which I assume will be highlighted in the GCMS notes. If not...

Regarding excessive processing time for parents super visa

At a certain point you may want to consider writ of mandamus to get receive a response (approval/refusal). Up to your family since it is expensive and you will have to consider whether chances of success are high. Without knowing parents background tough to say but a lawyer may be able to give...

    vulnerable Workers open work permit

If your permit was expiring in September you should have already had a PR application or other WP being processed if you were trying to remain in Canada. As others have pointed out an employer going bankrupt and closing is not typically grounds for VOWP. Your family should be returning home if...

Can I submit a H&C application while still waiting for a police clearance certificate?

IRCC doesn’t have to consider the webform if you submit PCC after submitting your application. Don’t actually think it is a good gamble take but up to you.

    Super visa for my parents

Would attach a letter explaining that they want to apply for a supervisa but they plan on visiting Canada for a few months every now and then. I would probably select a visit over 6 months when applying. If they have some funds would not put zero. Something is better than nothing.

PR Processing Timeline for February 2025 Inland Spousal Applicants — Will It Take Longer Than 12 Months

There is huge variability in processing times so would not focus too much on the 1 year mark.

Yes answered the wrong question. Impossible to say if you will be reported but yes any PR will be let into Canada.

Passing US border with valid PR, but not meeting PR obligation 730 day

You would have to prove that you are moving back to Canada to sponsor your child. If you have no intention of moving back to Canada then this is also not a good option. Your best option is for your child to live in Canada for 2 years.

Passing US border with valid PR, but not meeting PR obligation 730 day

You still need to be in Canada for most virtual ceremonies.
