Quit job, but need some more time in Canada

Hi,

I would appreciate any advice regarding our situation.

Our current status:

I have a temporary closed work permit, valid until January 2020. I quit my job in July 2019. As such, I am considered out of status.

My spouse received an open work permit since she is married to me, and is currently working.

Our goals:

I do not intend to continue working in Canada.

We want to leave Canada in December. Our flight is already booked. We have sufficient financial means.

I will require re-entry in November since I will go on vacation.

Ideally, my spouse would like to be able to continue her work until our departure.


What is the best way to reach our goals? Do I need to fill in form IMM 5710 (re-instatiation of work permit), or is IMM 5708 (temp. resident application) more appropriate? I am slightly confused by this.

If you have a valid work permit, you can remain in Canada as a VISITOR until the work permit expires.
You are not out of status.

This is actually valuable information. Out of curiosity...is there a maximum? (e.g. someone with a permit valid for 2 years but they quit in the first few months...do they still get to stay as visitors for 1.5+ years?) Also: are there any provisions for job switching or finding an alternative employer? (e.g. filing another LMA or whatever -- really curious)

You can remain in Canada as long as your work permit is valid. If you want to work for a new employer, you need a job offer from that employer and a new approved LMIA so that you can apply for a new work permit. Once the new work permit is approved, you can start working for the new employer.

Would this permit allow re-entry?

If the OP is from a visa-exempt country, this is less of an issue, but if OP requires a visa to get back in, obviously it will need to be valid.
