Citizenship application of child who is not in Canada but has PR

Hi,

I have to move back to home country for some personal reasons. my wife will stay there and I will come back after few months.

I will be eligible for citizenship in next 8 months. So my question is that can I apply for my minor son citizenship with me.
Also, what will be the answer of question 9B on child citizenship application form.

"Has the child left Canada for a total of 6 months or longer since becoming a permanent resident?"

Also, will it impact child's citizenship application if he is not in Canada.

If your minor child has lived in Canada for at least 730 days out of 5 years to maintain permanent residency status, then your child will be eligible to get citizenship along with you.

Minor children do not have to have fulfilled the residency obligation of 1095 days out of 5 years to get the citizenship. However, they must have had maintained their permanent residency status (which means they must live in Canada at least 2 years or 730 days out of 5 years) in order to get the citizenship along with the eligible applicant parent.

They can acquire citizenship but you must prove that they lived in Canada for at least 730 days in the last 5 years (or) prove that they will be living in Canada for at least 730 days in the next 5 years.


This is kind of tricky because any of your children who will be born after you become a naturalized Canadian citizen will be a Canadian citizen without having to live 730 days (no matter where they were born in). But since the children were born before you became a naturalized Canadian citizen and since the children did not become Canadian citizens with you at the same time, they must maintain the permanent resident status first in order to become Canadian citizens.


So, in order for them to become Canadian citizens, “Minor children must not have had any unfulfilled conditions relating to their permanent resident status”.

i have applied for family spnosorship , they passed the medicals, and still waiting for background check to be completed so they can get COPR.

at the same time, i have applied for citizenship as well, my app is in process since 2 months now,

i was under the impression, as soon as i become naturalized canadian citizen and when my familiy come here and got their COPR, i will apply for my kids citizenship as the no physcial requirements for kids is needed only VALID PR status.

first time i hear about it is need to prove they will be in canada for 730 days to fulfil their PR and subseqeunlty can apply for citizenship

do u have personal experience like this? any other references or threads u came across u mind sharing plz

my wife got a job offer from NHS under tier 2 category , we are still gathering information before deciding to live in UK or Canada?

I created my account when living in the UK but moved back to Canada about 7 years ago, so can't comment on the current state of living there.

I think there are a few UK forums but I don't know of any that are as in-depth and well attended as this one.

sorry to ask as this might be personal, when did ur daughter become PR? and how many days left for her to meet the eligibility?

my kids are not PR yet, but hopefully will be as their application is in process, so when they become PR, they have 5 years to fulfill the 730 days rule, and they have a valid PR,

so when i apply for their citizenship with newly acquired PR , will they be required to first fulfil the PR status then apply? ie. stay for 2 years then apply for citizenship

You were provided wrong information. Your child doesn't need to have 730 days in Canada first.
