Help ! Need help with PR/ Canada Work Visa post annulment

Hi All,


Could you please help me with one important question for my life here:

I was due for marriage with a guy working in Canada. Our hindu wedding in India got delayed for an year and we decided to expedite the process by applying for spouse work visa in year and also for PR in Canada with the spouse. (He had already applied for PR and decided to add myself as spouse in the application, hence the legal process). This was all done in good intentions and kept discreet between us and only between our immediate family because parents only believe in hindu wedding.


However, sadly, 3-4 months later only we decided to call it off and hence we had to cancel the hindu wedding. Consequently, we had to “annul the registered marriage with mutual agreement”. There wasn’t any change in the passport or name.

Moving forward to the present, all I want to know is - consider I get married, and if I have to re-apply for any visa in Canada/US/UK - tourist, work, PR etc...

Would the application form or embassy or anyone at all - ask or need my annulment certificate or its history or any clarification on it at present? (Say, basically, even when I would be giving my present status as married now?)

I just don’t want to come across it in any form, say, while I travel to US, Canada or Australia or maybe if in future I might decide to apply for PR in Canada or Australia (with my then husband)?

This would be of big help!

Have you cancelled your initial applications that are connected to your ex?

I believe that you are technically "divorced" as your marriage status if you registered a legal marriage before your traditional one and then anulled it. You'll need to use that marriage status and likely provide the annulment certificate for future applications.

Provided that you've withdrawn any pending immigration application connected to your ex, this won't provide you with particular issue in the future. You'll just need to document the annulment.

Yes you will always have to mention the previous applications and provide documentation of divorce or annulment. You would have likely run into issues with your application having had just a court marriage without the cultural and religious ceremonies. We see most of those applications refused so you have gone through all this for nothing unfortunately.

Also, we got this annulled because I didn't want a divorce tag without even having being lived with him or without being married to him. Hence, an annulment and needed no alimony or so. We did this to get free of visa things by the time hindu ceremony comes up.
Everything thus stands annulled and I am officially single.
It was all done with right intentions back them until he had a commitment phobia before final hindu ceremony.

If yes, will this document be required across all the countries and also across all the visa types (say visitor, PR etc)?

Yes you still were married and applied for PR when it comes to future immigration or visit applications. Your intentions weren’t actually innocent. You were trying to get approved without actually being fully married. You weren’t even living as a married couple. We have seen others attempt to get approved this way and all are denied.

I know I was married legally and we did have small ritual then. I had examples of friends and took their advice who did that and it went smoothly for them because they respected their alliance too (be it legal or traditional).
This guy didn't! However, that's a different side of a story.
I was only concerned to understand if these documentations are required to be presented in any of my next visa applications apart from Canada. I know there are requirements on divorce but I wanted to understand the same for annulment.

Sadly this court marriage would have never helped you get immigration faster but yes you’ll have to always include you previous PR application and marriage on future immigration application to Canada and if asked for other countries.

It's a historical fact that you WERE married for a period of time, even if you LATER had an annulment. Therefore, it's relevant for immigration purposes and you will need to a) declare it and b) provide supporting documents.
