TRV for sister in law

Hi Guys , Just hoping for same valuable input . I applied for my sister in law 3 times last year and she was denied every single time. It was for my son's 16th birthday celebrations and then my daughters birthday.
Cited reasons 1st denial Purpose of visit , Personal Assets , I am not satisfied you have sufficient funds Blah blah. She is a widow , leaving 2 children behind in India with her mother in law . Her India assets 5 crore , 50 lakh rupees, bank balance RS. 18 Lakh for past 5 years.
Then I wrote a nasty letter to immigration saying that are you even reviewing applications . Then we got second denial , this time reason better economic conditions in Canada and I am not sure you will honor terms of your visa. I wrote a letter to them that I worked with CBSA for 12 years and as a past federal employee I take full responsibility that she'd go back , my MP took personal guarantee too. refused again . I am going in again .
1.) she has huge assets , better life in india than she would ever have in canada. 2.) Kids are staying back and she is only legal guardian , she would have to go back . 3.) She does not have much formal education or training and that conditions in Canada Job prospects are not bright for her in Canada . 4) With kinda assets she has , she will have to go back , only and only she is looking after all affairs . Does it sound right ? I sent my CBSA credentials and they didnt even look at it . Morons . Any advice @scylla @PMM @Bryanna @canuck_in_uk @Leon

Oh also for India , would it be better if we applied on line OR if she should try manual submission at Chandigarh office . Thx in advance

The birthday of a niece and a nephew is not a compelling reason to visit, in addition, as you'll know, family ties in Canada create an overstay risk. The visa officer will wonder why the 16th birthday of a niece or nephew requires an extremely expensive trip to Canada.

I doubt they're reading your nasty letter, but including your CBSA credentials may be considered an improper use of authority, as would any "guarantee" from an MP, which I doubt was a personal guarantee.

I hope future applications work better for you.

Sending nasty letters is an easy way to get a visa denied if the visa officer was on the fence about approval or denial. Assets can be transferred electronically and papers can be either scanned or be sent between countries via courier. Many people leave their children behind when they come to Canada to secure status. The fact that she has no job prospects in Canada is a negative not a positive. Also the fact that she is unemployed means that has one less tie to India. Agree that the reasons for her visits were not strong and applying 3 times in a year raises concerns about her desperation to come to Canada. Your guarantee that she will leave is not enforceable and neither is the MP's guarnatee. I am shocked that an MP would be willing to say that he will guarantee her return siclnce he has no ability to make her leave. How old are her children? She has to find more ties to her home country. Has she travelled before to countries similar to Canada that require a visa. That may be another concern. How long did she say she wanted to remain in Canada.

Hopefully you put your Government # on your credentials so they can send it to your manager. Seriously? You were trying to use your position in the Government to sway another departments decision? Unreal
No wonder civil servants get a bad rap

4. Does she pay taxes on all the income and assets that she had declared for her TRV applications?

5. How old are her children and what do they do? Do they live with her? Are they married?

*Part Inheritance , Part income from land lease

3. It's extremely unusual for someone to have INR 1.8 million idling in a savings account for 5 years. What was the source?
*Family is rich , land leases , husbands money when he passed away etc

4. Does she pay taxes on all the income and assets that she had declared for her TRV applications?
* She does not.

5. How old are her children and what do they do? Do they live with her? Are they married?
* Kids are 5 and 11 , both in school.

I am a former , long time out . All I was saying that I have record which can be looked at ( If we are legally taking responsibility for someones return).

You cannot legally take responsibility for a temporary visitor's return, which I'm sure you know already (it wouldn't change admissibility at the border, would it?)

Unfortunately, it is quite easy to see why your sister-in-law has been refused thrice. It would be quite inappropriate to vent your anger and frustrations on IRCC. She has a weak application + weak purpose of visit (probably seems like she is visiting for some other reason i.e. not a genuine purpose of visit).

As your sister-in-law does not seem to adhere to the laws of India, it would give the impression that she won't follow the immigration rules of Canada as well.


1. No taxes = None of the income, bank balance, etc that she has submitted is legit. It explains the refusal reason for her financial assets.


2. Based on your post, it seems that although these assets were owned by her deceased husband, she has not transferred all the assets.... or else she has partly transferred the assets to her name.... by legal process.


3. With this significant bank balance and financial assets in her name, but no taxes.... she can expect the India tax man to be knocking on her door anytime. Travel abroad will only expedite this scrutiny by the Indian tax authorities.


4.. It seems unusual if the purpose of each visa application was to visit you/your family for the birthdays of your children. Does she have history of being with your children for their past birthdays?


5. I assume there is no legal or written agreement for the land lease too. So, she cannot account for the income generated from leasing that land


6. If the assets are legally in the name of her deceased husband, she does NOT own them unless there was an inheritance will or a court decree transferring this ownership to her name.

Depending on how those assets were acquired, even her mother-in-law or her children could be the legal owners of those financial assets and property
